Manziel autograph trading cards cause stir
http://espn.go.com/blog/playbook/dollars/post/_/id/3042/manziel-autograph-trading-cards-cause-stir
Manziel autograph trading cards cause stir A Texas-based trading card company caused a stir on Wednesday when it announced that a high-profile redemption card already inserted in its packs of two of its football sets would be an autographed Johnny Manziel card. The company, Leaf Trading Cards, maintains that the company is doing nothing illegal and won't compromise Manziel's eligibility. "Leaf wishes to clarify that neither the cards, the use of the signatures included in the cards, nor the artwork, is sanctioned by or endorsed by the personality (Manziel), his university or any other organization or licensing body," the company said in an announcement posted on its website. Leaf president Brian Gray told ESPN.com that his company acquired the signatures from third parties with the intention of putting it into product, but neither Manziel at the time he signed them nor the sellers of the signatures knew of Leaf's intention. "This kid has obviously got a future ahead of him," said Gray, alluding to his assertion that what the company has done won't compromise his eligibility. Gray would not say how many autographed Manziel cards would be distributed to those who had redemption cards but did say that Leaf commissioned unique artwork for each card, which in the company's opinion satisfies the requirements of the First Amendment. "In our business, we buy products and use cut signatures, like in this case, when we can't strike deals with a personality or if they are deceased," Gray said. "We can tell just by looking at Johnny's signatures selling on eBay that he's a compelling personality and doing this adds value to our product." Attempts to immediately reach Texas A&M officials were unsuccessful. Manziel recently sued a T-shirt retailer for using the words "Johnny Football." Manziel filed to trademark his nickname last month. Manziel told ESPN's Kirk Herbstreit that Texas A&M and lawyers hired by his family are working together to send out cease and desist letters. "If they say, 'Well, we're going to keep selling it' or whatever, that's where it comes to a point where we'll sue for damages," Manziel said. As ESPN previously reported, the NCAA has told officials in Texas A&M's compliance department that Manziel would get to keep damages awarded to him from legal outcomes while maintaining his eligibility. |

That last paragraph tells you everything you need to know, setup from the get-go.
Gray: We can't pay you for these Johnny Football's dad, but we can "settle" *wink, wink* and ya'll get to keep the money. |

He does seem to come across as pretty full of himself ever since winning the Heisman

As I posted in another thread, I am shocked this entire set has not been shut down. Though the cards lack logos, they do violate intellectual property rights.
In 2008's LSU vs Smack Apparel Co. the 5th Circuit Court of Appeals ruled that school colors used to represent affiliation with a school are protected. If TAMU has not granted permission, these cards could be viewed as trademark infringement. Brief from Lexis Nexis: https://litigation-essentials.lexisn...8e5f45b4b560f5 |

I see them getting in trouble, as they should.
I mean really why must they push and push that line. Just do what you know is fine. No need to stretch it until your company goes down for being stupid. Leaf is saying it's "artwork" but yet the article above starts out by stating the obvious "Manziel autograph trading cards cause stir". |

Leaf appears to be making money through violating property rights owned by others. No one borrows your car to generate revenue for their company without your consent. I think the TAMU QB has concern about his brand image. I think the NCAA licensing firms should be all over the perceived affiliation these cards indicate. The latter is the bigger deal in my opinion. |

I'm not following your logic. Or am I missing something. |

Leaf will likely win any suit that's filed against them in this instance. I imagine they knew what they were doing, and they were careful in deciding how to do it. |

Why should everyone but him be able to profit off of his autos, merchandise, etc but him?
I mean if the guy trades an autograph for a fricken sandwich he is declared ineligible but its ok for people to buy and sell autographs he gave for free? Everyone on this thread would be pissed off if they found out their autographs were selling for hundreds of dollars yet you havent received a penny from it and wont unless you sue but then we claim hes very full of himself? Personally I agree with his stance. Outside of the university, if hes not going to make any money off of his likeliness, hes going to do his best that no one does. Not sure how that makes him conceited, arrogant, or full of himself. |

He got paid for the autos, there is no way he just signed them for a friend. Most college athletes get paid for autos. If the NCAA really digs in to this they can track the money down. The friend or associate gets paid for the autos and then the friend or associate transfers the money to the player.

If anyone TRULY believes he didn't get some form of payment for this, they are incredibly naive. How many college age kids run around in casinos flashing wads of $100s for pictures? This guy is getting PAID from several sources. He's not alone, to be sure, but he's not very smart about it, also to be sure. Probably the most corrupt college athlete since Reggie Bush...and it will all come out in the next few years, like it generally does with players of this magnitude. All that being said, I agree with what many are posting about the stupidity of Leaf, they continue to flirt with disaster. They may have found it with this stunt.
