So, I have never left negative feedback for a transaction on ebay but at this point I am considering it. What I would like to know is, do others feel it is justified or I am overreacting? Here is the situation.

I bought a dual autograph on eBay a couple weeks ago. When the card arrives, not only are the autos different than the ones shown in the listing but there is noticeable damage to one of the corners (also not seen in the listing). I immediately started an "Item Not As Described" return request showing images of the card I got outlining the difference from the one pictured in the auction. The seller didn't respond to the case until during the night of the last day before I could escalate for an eBay ruling. Now, the card is on it's way back to the seller and should be arriving today. I anticipate that they will most likely drag their feet on refunding me, but that remains to be seen.

This is the second time I have been sent something that didn't match the listing (neither made any mention that the item I receive may not be exactly as shown in the picture) and I suppose I am just tired of being jerked around by the sellers. Anyway, do you guys believe that a negative a legit feedback to leave? I have considered the fact that if the seller refunds me within a reasonable amount of time after receiving the card I may just let it be and move on. Thanks in advance for your opinions and sorry for the long read.

Wait until you receive the refund then neg away.

You should get your refund as soon as it shows delivered on the tracking number, within a few hours depending on when paypal catches that its delivered.

As for a negative - don't take all your frustrations out on one seller. If you truly had a negative experience then leave the negative. Just don't neg him because you're tired of it happening. Each experience could be the result of something different.

I think it sounds fair to leave negative feedback not only due to the hassle but to warn others that this seller posts one item and then ships another. I do agree with this comment though to not get too carried away with negative feedback. There are some people on this forum that seem to leave negative feedback if there is a misspelling in the description! "He used there instead of they're so I will leave negative feedback" lol

I will give my nickels worth from a sellers perspective.

First - you have every right to be unsatisfied with the card you received if it is flawed/damaged and is a different card from the one in the listing.

I will say that very often I have ended up with multiple cards where I only scanned in one and set the "available" to 2, 3, whatever - what happens is that one or two sell and you are left with a card that may not look like the one in the photo (different jersey color, etc). If it was something I noticed, like a jersey swatch being different, I would email the buyer to advise - but I can pretty much guarantee that I wouldn't notice in the event of a different auto (assuming there were no major smears, issues, damage, etc).

So -
In this case, I can understand you getting a card where the autos look different however getting a damaged card in obviously unacceptable.

That being said - if the first communication I receive from a customer that is not happy with a transaction is a formal eBay dispute, I am far less likely to be overly accommodating. I would recommend a quick note to the seller first advising of what has happened and, in most cases, the sellers will respond favorably. Some may not, but at least you gave them the opportunity to step forward and right the situation.

Accidents happen and often times the seller will just ask for a scan of the damage and will then refund the money without the hassle of wasting postage to send a jacked up card back and forth. Better for both sides.

As far as feedback goes, go with your gut but I would say that you aren't out anything and have been made whole by the seller (assuming that happens) so negative feedback is a bit of an overreaction in this instance.

Then he refunds me using an e-check which took another week to clear. I really feel like the seller was making it as hard as possible for me to get my money back after sending me a damaged card. I think I may have to leave a negative for this transaction.

The e-check may have been the only option for the refund. Many sellers will dump all their money out of Paypal and into their bank accounts. This ensures that anything they buy is with a CC. Ebay will not process refunds with a CC and that forces sellers to use a bank account.

This. I've refunded echeck with paypal funds in my account. I don't know why it does this but its not on the seller.
