View Full Version : Buyer trying to return card as damaged, do I have options?

Had a buyer on Ebay purchase a card and sent a message today saying the card is damaged. This card was MINT when it left my possession as shown by the picture on the Ebay auction. The buyer contacted me today claiming that the card has damage on the lower left portion of the jersey window and sent a picture that looks like the card had been bent which caused a pretty bad crease. I spoke with Ebay and they said that they cannot stop the buyer from returning the card and getting a refund.
Is there anything that can be done about this or am I out over $170 and left with a worthless card now?
This was my picture used in the auction showing the card to be in great condition:

Here is the pic the buyer sent me showing the creases:

Ebay told me that I may need to supply them with several additional photos of the card (which is impossible due to it now being damaged), and on top of that, any negative feedback received as result even if I am the winner of the dispute cannot be removed.
Worst case I figure is I'll file an unauthorized charge with my bank and file a police report if the buyer files a case with Ebay to get a refund.

This is a good way to get your ebay account shut down, along with any payment account you might have had linked to it (PayPal). You should have really read the terms and conditions a bit better before you started selling on ebay. There's nothing you can do but accept the return and refund the sale.

That's okay actually, I'd like to close my Ebay account, it's near impossible to sell items successfully on there in this day and age, and there isn't anything on there I want that I can't buy elsewhere. I've been selling on Ebay for years without any issues at all until this year. So you're okay with someone committing fraud and being defended by a company? It's pretty sad you feel fraud is something that's acceptable but it's buyers like you that make the community a horrible place.

How can Ebay prove the card was not damaged by you or in shipping? You are responsible for getting it to the buyer regardless. Fraud is part of doing any selling no matter what you sell online there is a risk of being scammed. If you cannot afford to lose it you should not be selling it online. Ebay policy is pretty much inline with what the Credit Card companies require of them.
The card is not going to be worthless, it just maynot be worth as much as you hoped.
If you shipped in a magnetic then that could be the culprit. There have been many cases where magnetics will cause damage in shipping.
YOur photo really is not close enough to see if there was anything or not, but there is a small anomaly I am seeing in the area of the crease in that photo.

Got to suck it up and take the return.
I hate to be "that guy" but seems like that one dude with 1 Feedback who has bid in like 80% of your auctions may have been the source of your other frustrations- hopefully its not what I'm assuming and you blocked him

I didn’t say I can’t afford it, money is no problem for me. It’s the principle and again I will say this is why the community has so many scammers. Back when collecting was honest, people frowned upon fraud. Maybe it’s the new normal now.

So you would block him just for making a return that looking at something the sellers photo raises some concerns.
There is a little spot near where the crease is that shows in the sellers photo. Then on the back in the area the crease would be there is a white spot that appears to be paper loss on the card. Could be something on the holder but not certain based on photos the seller has in listing.
Notice how the OP took his EBay ID off real quick too.

If it is a surface crease, there wouldn't be anything to see on the back.

I am seeing a weird pixelation on the front as well though. It could be nothing.
Regardless the crease is there now and the sellers photos are really inconclusive a surface crease would be hard to see in a photo unless you were focusing the camera right on it, so there is really no proof of anything for either side. I see nothing in the buyers feedback history that would indicate issues like that. He has never left a neg or neutral nor do I see any that indicate there was an issue the seller fixed. Also see nothing on the sellers side indicating any past issues.
This to me just seems like one of those things that its a he said she said type issue.

In claiming fraud are you asserting that the person bought the card to intentionally damage it and return it to you? How do they gain from that? Do you have a list of enemies or something?

This is not a block for me. Damage on card is right where this stuff usually occurs if damaged in mail. OP offered no details of how card was shipped.
Can't believe card sold for that amount either-very strange.

OP took his ID down as soon as I made my post, think I hit something on the nose with my assumption in my earlier post...

Also, for OP to know shill bidding IS a form of Fraud....

If you didn't hand-deliver it to the buyer, how are you 100% sure of the condition the buyer received it in?
If you shipped it in something safer and it was a young player who got hurt or started playing poorly after the sale I could see the possibility that the buyer intentionally damaged it so they could return it. In this case, what is the motivation for them to damage the card? Why don't you take responsibility for shipping in a magnetic holder instead of making accusations you can't back up?

No way to know card wasn’t creased in listing photo. Terrible, low res, far away, angled pic.

It's called having a life and not being glued to a sports card forum all day. I'm very happy to get out of this hobby since everyone automatically assumes Shill bidding was done on this item. This community and hobby has become trash like most collectors.
I got my money back and the item was tossed in a box with the rest of my remaining cards and put in storage so I'm not upset anymore.
It's sad that a bunch of people have nothing better to do than assume the seller is in the wrong like most of the other posts I've seen with issues like this. Seems like the collecting hobby has become a haven for idiots that think the seller is always in the wrong.
Also, to the retard above that said the police would be all over my report; It's called procedure and is required out of most things done in life. Clearly you are an idiot.

Stayed up later than usual to bid and win his auction (I'm night shift).
Should've known since he used another eBay ID that this was a fraud account. He refunded my money 30 minutes later and refuses to ship.
He sent me this bogus message:
Hello,
I apologize but due to Ebay holding the funds related to this transaction for 30 days I have just refunded the money to save you the hassle of waiting 30 days for the funds to be released to me.
Thanks,
-Paul
I responded by copy/pasting a BlowOut PM he sent me a while ago...
..sure.

Hey buddy!
I'm trying to move a bunch of stuff I have on top of the lot I have listed but can't seem to gauge any interest at all. I've listed on Ebay literally 9 times in the last 2 months and every time it has ended in a non-paying bidder. Seems to me it's impossible to sell cards these days so I think I'm stuck with a bunch of cards that are worth zero dollars now.
Any thoughts?
Thanks,
-Paul

He replied back on eBay:
Sweet, one of the scammers showing themselves!

Paul you should be banned.
You wasted my time.
I'd like my cards.
Don't ever PM again about not being able to sell your stuff!!!
I'll be making a separate thread tomorrow in member's feedback section --- got to go to work right now.

From here? He might be, but we have seen shill bidders and other bad Ebay members just keep right on going.
With Ebay they will likely ban his ID with -2 feedback soon, the other they may or may not ban at that time. Per Ebay rules the other ID should be banned but that is not a guarantee. Ebay is not very smart when making links like that.

The language alone should be enough to get him banned. houdini can decide that.
