So last week I bought a few cards from Ebay. Two Moasic and a green prizm Zion, Two Rj Barrett Prizm Base and a Silver. They were delivered today, well an empty bubble mailer was delivered. When I opened the mailbox there was a clearly cut open envelope sitting there.
The Package was delayed for 4 days right after it was picked up from the seller, then it quickly made it way to me. There's no notice from the post office about damaged mail. Could it make it to my box with nobody noticing it was open?
I'm waiting on a response from the seller. Not sure where to go from here, anybody been through a similar situation?

Maybe it was stolen after the mail was delivered. Usually USPS will put it in a "We Care" bag if they noticed the damages.

That's always a possibility, Ive had lots delivered and never had a problem before but there's a first time for everything. There was also a PWE in there that was untouched

File a police report immediately and also contact the post master in your area.
I assume the cards are raw and not graded?

Why would the thief bother to stand there. Open the mail.com take content out and then put back the package. A lot easier to just grab the mail and go. Also then people wouldn’t know if package was even stolen or not versus this way, they know someone opened the mail and will report to police

Postal workers probably didn't notice the mailer had been opened. Especially now with Covid, shippers across the board are being overwhelmed. As for a we care bag, a mailman once handed me a completely empty Amazon mailer and no notice or anything else was attached.

Quick update, I contacted the PO, Sheriff, and the local shop. All said they will let me know, I don't expect any help from them except maybe the LCS, hes an honest guy and will definitely contact me if they show up in his store.
I also talked to the seller and even though the Package was marked as delivered on the tracking# he offered to refund half of money which I thought was extremely nice since he could have said it's not his problem.
So I'm still going to be out $200 plus any possible future gains. It sucks because I really wanted those cards and I'll never get that good of a deal on them again. Also got a PO box while I was at the PO so I'm protected in the future.

What do Ebay rules say about this? I think it is the seller's responsibility to insure all packages. He should refund you in full.

From what I read the sellers responsibly ends when the tracking confirms it was delivered. It's on you to secure the Package once it's in you mailbox.
I have no clue if someone along the way took them or they were taken from the mailbox. Insurance wont cover anything after delivery is Confirmed. Who's to say I didn't take them out and claim they were stolen

He wanted to make it look like the cards were stolen from the package. Of course he offered half of the money back as he still kept the cards and got half of the money.
I would guess that he would not be stupid enough to try to sell these same cards via his ebay account again but you never know.
A case should be opened with Ebay as SNAD and give the details that the seller shipped you an empty cut open envelope. He knew once it showed delivered that he was in the clear.

I have no clue if someone along the way took them or they were taken from the mailbox. Insurance wont cover anything after delivery is Confirmed. Who's to say I didn't take them out and claim they were stolen

File a complaint with Ebay. At worst they may cover the cost out of their own pocket. Just push them hard.

You need to contact your local USPS postal inspectors or file a claim online:

Perhaps the deal was so good because the seller is a scam artist?? And maybe he offered half so readily because he is a scam artist??

The seller has 650+ Positive feedback in the past year with 0 negative and if it was Shipped with the Package opened I'm guessing it would have been noticed somewhere along the way. So I'm inclined to believe it happened during the 4 day delay in Shipping or they were taken from the box

Nope - No sorting is being done by hand at this time and the machines would not have caught that.
The PO does not care about the weight as long as it shows more than what the package actually weighs.
This is a scam for sure.

Sorry for your loss. Fight hard on eBay, or USPS. There is no way USPS didn't detect that, I believe the carrier, or the handler is the culprit. That package went through a few hands. Do you know the carrier? Some of you might remember there was a PSA MJ card that was stolen through Fed Ex, the guilty guy was the Fed Ex guy. I don't think the eBay guy would cut like that and send it through the post office, most likely it would be returned.
This year, so far I've had USPS dropped off at the wrong house. And a breaker inadvertently didn't put the card in the top-loader. I received it bent, luckily it was a $.99 not a rookie card. Then I received a package missing 1 card out of 2. Only this year.. be careful on our packages.

Question. Does it look like the package he used may have been a recycle? One that he just put his label over the top of another? If so, the top doesn't appear taped at all and maybe he just forgot to tape it up when he shipped and it slipped out?

This happened to me last year with a 2013 Giannis Red white blue Prizm. It was a low feedback seller. Package came empty with a slit. I had my doubts at first with someone stealing it en route to me, but looking at the cut on the package, the hole wasn’t big enough for the card to be pulled out unless u bent the card inside the top loader. And the seller never really seemed bothered about it and I just caught him lie after lie with his answers.

Insurance is for damaged or lost goods. This would definitely fall under those guidelines.
If you took them out and reported them stolen, that would be fraud. There are laws for that.

Getting to know your mailman/mailwomen is really important. My five year old made an impression on my mailwomen and she now drops off packages at my door to see her every day. Before I would have neighbors bring packages over to me because she put them in the wrong box. Now my mail is 100% correct all the time.
Something doesn't seem right here and the seller so quickly agreeing to the 50% return is fishy. For what you paid it should have been delivered in a USPS Priority Box with insurance. I would never ship $400 cards in an envelope. I mean it would have cost $5 extra bucks!

I honestly don’t think the seller is trying to scam with that sort of feedback record but I’m surprised he didn’t insure something at that price point. I’m usually in the over 100-150, it’s getting insured boat.

I only insure over $750- which is when Ebay requires sig. Conf. 100-200 is low end. I hardly feel like insurance is worth it unless the card is $5k+ but I do buy anyways at $750+. Under that, no way. I'd think it'd be very unlikely for most sellers to insure anything below 750 but IDK it's all subjective.

I am still on this one being a scam - the piece that makes me think so is the seller's offer to send back half of the money and "split" the loss with the OP. No way a seller with a package that shows delivered offers up something like that unless they knew that the package was going to show up empty.

Envelope? You mean PWE? I never ever ship in an envelope. Horrible. Do you know about bubble mailers? I use Bubble mailers like most sellers for just about everything. I get a lot of stuff in envelopes myself from other sellers and it doesn't bother me but I prefer bubble mailers. It more depends on the card than the value, RPA's require different kinds of protection etc. I will double bubble mailer something if I think it needs it. Provides lots of protection. I suppose now that I think about it that's usually my preferred method. I do use common sense more than a set system to be honest so sometimes for stuff in that range you're talking about I'll use a large bubble mailer rather than a small one and add extra bubble wrap around the card. I just use common sense to make sure the card is protected. Never had an issue either way. Anything over $750 is boxed. If something's over $5k, I double box it, and seal all of the seams. It's a hassle to open but worth it to prevent tampering. I also take videos and photos of packing it up as well as photos of sealing it at the post office with the post office worker. To this day I've never had a card damaged, lost in the mail, or an insurance claim. So should be good to go.

Do you even use Ebay? 99% of cards in the $10-xxx range are sold in bubble mailers. Literally no one is using priority mail for anything under $200. Lol. You are also showing your inexperience because you can box stuff without using small flat rate priority mail, that is probably the worst and least cost effective method you could choose.

If it's that low-end it's important to communicate your expectation clearly. I did have a buyer request a box once for a $150 item and I boxed it for him. Totally fine, just ask. If we're talking eBay, it is completely on the seller to protect their goods when shipping. It doesn't matter if the buyer asks for a pwe, bubble mailer, or priority box. The seller has to protect themselves as much as possible and ship accordingly.
I will be shipping out a $500 sale tomorrow. It will be shipped in a priority box (protected with bubble wrap and stuffed with newspaper to prevent against sliding around), with insurance and sig confirmation. I will be doing my part to protect myself from taking a $500 loss. It doesn't matter to me how the buyer wants it shipped.
You seem to be new to this concept.

If the seller shipped without insurance, then this would be his best option. Otherwise, seller loses everything when buyer makes the claim.
OP, you need to open a dispute against the buyer. It is not your fault at all that your package did not arrive as should. There is no reason that you should have to eat a $200 loss.

All shipping methods are placed in the description as well as the listing.
Learn the basics, I've been doing ebay for a decade+ with no problems in terms of damage loss or insurance. Luckily, I vet all my buyers and have a block list the size of 10 paragraphs which avoids these kinds of problems that come from newbies like yourself. If you'd like to provide your Ebay ID, I will happily add you to this block list. There's also 3rd party insurance stuff you obviously know nothing about.

I said in the post I would pay for it and it was my preference. Of course I would communicate with the seller. I also attached a $200 minimum on it, which is a loose number. It isn't like a $199 goes into a bubble mailer and $201 goes into Priority mail. Plus it really isn't that more expensive if you don't deal with high volume.
Here is my rational for using USPS Priority Mail for a card over $200 for an occasional seller on ebay. I don't have to buy a supply of small boxes to use. I have a few USPS Priority boxes at my house and it is ready to go. With the ebay discount it is only $3 more expensive. Even less when you don't have to use a padded mailer, which costs about $0.50 buying from Amazon after taxes. Plus recently there is a BIG difference between how quickly First Class and Priority Mail get delivered in California. I have First Class packages just sitting in post offices for weeks now. Priority mail gets through much faster. If a package of mine ever goes through Bell Gardens, CA I know I am going to have to deal with an angry buyer.
Now what is the actually price of an item that I would like a seller to use Priority Mail, the answer is I haven't bought a card that high yet. Is it $300, $400, $500, ... No idea. I will cross that road when I get there.

I think most of these issues are avoided per the fact shipping methods are listed in the descriptions and listings on Ebay. So I don't think people who want priority mail cross with people who are shipping first class since it's super obvious from the listing and description. You are right that if you're communicating clearly and reading the listing then you'll have no problems, it'd be scummy to expect a different method than what is listed in the listing though. Although in my particular case if you requested it before buying it'd be no problem. This is why it's so important for buyers to read listings and descriptions. As far as the difference in speed from first class to priority from California, I bought a card from California Tuesday that shipped first class and got here on the east coast yesterday. Plenty fast.
The good thing about Ebay if you are not a scumbag is you can read exactly what a seller is offering and buy accordingly, this avoids most issues. I've never run into someone wanting priority mail because I clearly list ships usps first class if it does, I suppose that prevents most of these issues. You are right that I probably mistook what you were saying with what some of the others here are saying, as long as you're communicating and/or reading listings/descriptions you'll be more than fine.
We are getting off topic here. OP, I'm gonna end this here so you can have your thread back. Sorry about that. Hard to tell if this was theft or a scam, if I was the seller in this case I'd make you whole but I think your agreement is kind and if the guy is reputable, I'd do the same if I was the buyer.

I bought a card from California Tuesday that shipped first class and got here on the east coast yesterday. Plenty fast

When I do ship things over 1 lb (not media) with Priority Mail and it always gets there quickly. Right now I would send anything over $200 with Priority Mail because of this. I just got an ebay message from someone in California that hasn't received their package yet from July 14th. They are literally 5 hours from me.

I do not doubt this. I believe this is due to recent events surrounding the USPS and I do not want to get political here. Sorry that you're going through that. My package avoided those hubs. I don't doubt what you're saying, I believe this is more due to recent events than a general rule on Ebay, things are still fastish around here but I don't even think Priority will protect you from what you're experiencing. Anyways, we are a bit off topic so let's let the OP have his thread back.

Do you even use Ebay? 99% of cards in the $10-xxx range are sold in bubble mailers. Literally no one is using priority mail for anything under $200. Lol. You are also showing your inexperience because you can box stuff without using small flat rate priority mail, that is probably the worst and least cost effective method you could choose.
That's why I said it's a personal choice for sellers whether to prioritize secure packaging or dealing in low value cards. I also acknowledged that priority mail boxes would not be a cost effective choice today but that doesn't mean sellers should sacrifice safe shipping.
Bubble mailers risk damage. It doesn't matter how much cardboard the seller stuffs in there, a bubble mailer will always provide less protection than a box. That is a given and the fact that I recently received a card shipped toploader/cardboard/bubble mailer that was obviously crushed in the mail proves the point.

All shipping methods are placed in the description as well as the listing.
Learn the basics, I've been doing ebay for a decade+ with no problems in terms of damage loss or insurance. Luckily, I vet all my buyers and have a block list the size of 10 paragraphs which avoids these kinds of problems that come from newbies like yourself. If you'd like to provide your Ebay ID, I will happily add you to this block list. There's also 3rd party insurance stuff you obviously know nothing about.
Lol if a buyer messages me and wants pwe instead of what is in my description, it's not happening. Negotiating the shipping method is a moot point. If there is an issue with your shipment it falls on you if your item is not insured (be it from your delivery service provider or ThIrD pArTy). Best of luck with your third party insurance as well.
I've been selling on eBay for 13+ years. Please get off of the OP's thread, as you are not really offering anything to his issue. Encouraging him to take a $200 loss for no reason is horrible advice. But, it doesn't surprise me coming from a seller like yourself, who doesn't really believe in insurance.

I never buy the insurance. I always charge $2.99 for shipping. If a card goes for about $500+ I will put the card in a padded envelope inside a small flat rate box (at my expense). Anything below that goes in an ebay envelope with bubble wrap. Have had no issues.
In regards to the OP's situation, you need to file a claim that you did not receive the item wit PayPal. I have had sellers send me packages filled with garbage instead of cards. Even if it shows up as being delivered, you will still win.

I filed with Ebay, the postal inspectors and let the LCS know to keep an eye out. Hopefully I get some good news in a few days.
