A 9 year-old girl and her lawyer father are battling Panini in small claims court, over a redemption that Panini is not able/willing to honor.

Hobby Lawyer, Paul Lesko provides an excellent recap on Twitter. Informative and entertaining and a great follow for hobby legal news. https://twitter.com/Paul_Lesko/status/1362388651779502088?s=20

Here's is a breakdown of the complaint, which could end up being relevant to all redemption holders and likely why Panini is putting up such a fight.

Agreed, it shouldn't be "sad" it should be "suffered extreme emotional distress".

This is awesome. Redemption cards and the level of customer service that comes attached with them are a joke. Got a good chuckle when I read that Ms Rand's favourite team since she was one year old is the Philadelphia Flyers. I wonder what her second favourite team was at the time? I wonder what the criteria for that would be for a one year old?

Life is full of disappointments.
Get over it.
Lawyer Daddy should just buy her a Giroux card if she's that broken up about it.
"Fan" since the age of 1 Y.O.! Yeah, OK!
I don't follow Twitter so I don't know all the details but what year was the box from? When was the last time a Giroux auto /60 was in a Panini product anyway? 2013?
Chances are the redemption was expired when she pulled it?
But hey, this caused her to be 'sad'.

The redemption card was a Claude Giroux Dominion Autograph Patch pulled from a box of 2012-13 Panini Prime.

Here's some of the information the Plaintiff is requesting from Panini.

- The number of Claude Giroux Dominion Autograph Patch Cards #84 that were offered in redemption cards in the 2012 Panini Prime (12-13) Hockey product and/ that were sent to customers following submission of the applicable redemption card
- Panini America, Inc.’s actual possession of Claude Giroux Dominion Autograph Patch Cards #84
- Customer complaints related in any manner to redemption cards and/or the redemption process since December 7, 2020;
- Panini America, Inc.’s policies and procedures related to the redemption of redemption cards submitted to the company after the passage of the date identified thereon as the expiration date
- The process by which Panini America, Inc. determines whether to offer a comparable card in lieu of a card identified in a redemption card;
- The process by which Panini America, Inc. determines whether a particular card is comparable to a card identified in a redemption card;
- The process by which Panini America, Inc. determines whether to offer panini points in lieu of a card identified in a redemption card; and
- The process by which Panini America, Inc. determines the number of panini points that will be offered in lieu of a card identified in a redemption card.

Good. There needs to be more of this. I spoke with Paul Lesko years back, before the Panini points scam, and even then he said he didn’t know why there weren’t more suits or a class action or whatever. Maybe enough people are finally tired of it.

And I don’t get people who defend these companies. The card companies are clearly wrong here... it’s 100% on them. I can’t imagine this practice being accepted with any other products... go to Walmart, buy a toaster, get home and open it to find an IOU instead? No one would tolerate that.

I’m cynical enough to believe this entire redemption process is designed to screw the customer and save these companies money. Promise a decent player, never fill it and instead take the opportunity to clear out old inventory. And Panini has taken it to another level with the points scam.

Wah wah wah.

In most jurisdictions, you cannot be represented by a lawyer in a small claims court. However, she is a minor so she needs an attorney.

From Paul Lesko’s twitter and in one of Panini’s filings.... “Panini is asking if the case continues...it wants a protective order to screen the public from its trade secrets involved in its redemption process.”

As Paul points out, there’s no trade secret here. But maybe the secret they don’t want made public is the redemption process is broken by design.

Hopefully the judge rejects this as excessive.

Any document production done by Panini would be subject to privilege production and redaction subject to judicial review on appeal of redaction.

Is "Panini Points" even trademarked? Have to research that one. Uphill battle here by Panini to protect "trade secrets".

Good on the lawyer for taking the a card company to task. Too often redemptions are not honored

In a blow to any collector, who happens to come across expired redemption card(s), the Judge ruled that Panini's redemption expiration date was enforceable and ruled in favor of Panini today.

Not a surprising outcome but rooting for the little kid, I was disappointed to see the update.

Freaking Panini, send a rep to visit Claude and get a card signed for the 9 year old. Damn turds over there. Dont they have weekly management meetings where this kind of stuff is screened?

What a waste of time crying over pulling an expired redemption to the point of going after a company. Disappointment? Sure. Litigation? Just WOW :doh:
I agree with the court decision.
Daddy Lawyer should have to pick up the costs for being a numb-skull.

Its small claims court, you dont even need a lawyer but because she is a minor, she does. It costs virtually nothing.

Yes. Clearly the consumer is in the wrong (https://en.wikipedia.org/wiki/Bait-and-switch)...

There were still costs involved for Panini to have to defend a frivolous action against them. You don't think that their lawyers charged them for their efforts?
