Membership as a class member in the Electronic Arts Litigation is the result of a lawsuit filed in the U.S. District Court, Northern District of California, Oakland Division (Case No. 08-cv-02820 CW).

What Is This Class Action About?
The class action lawsuit alleges violations of California's antitrust and consumer protection laws in connection with the sale of certain football video games. Plaintiffs, purchasers of Electronic Arts' football video games, claim that Defendant Electronic Arts entered into a series of exclusive licenses with the National Football League (NFL), National Football League Players' Association (NFLPA), National Collegiate Athletics Association (NCAA), and Arena Football League (AFL), which Plaintiffs claim foreclosed competition in an alleged football video game market. Plaintiffs allege that this series of exclusive licenses caused customers who purchased certain football video games to be overcharged.
Defendant Electronic Arts has denied any liability and all allegations of misconduct. The Court has not decided whether the Defendants did anything wrong, and this Notice is not an expression of any opinion by the Court about the merits of any of the claims or defenses asserted by any party to this litigation.

Who Are Class Members?
The Class includes all persons who, during the period January 1, 2005 to the present, purchased the Madden NFL, NCAA Football, or Arena Football League brand video games published by Electronic Arts with a release date of January 1, 2005 to the present. Excluded from the class are purchasers of software for mobile devices, persons purchasing directly from Electronic Arts, persons purchasing used copies of the relevant football video games, and Electronic Arts' employees, officers, directors, legal representatives, and wholly or partly owned subsidiaries or affiliated companies.

What Should I Do? (Getting Further Information)
If you believe that you may be a class member (see above "Who Are Class Members"), you should get more detailed information about the class action and its potential effect on you and your rights. To Remain a Class Member
If you are a class member and you do nothing, you will be bound by the court's rulings in the lawsuit, including any final Settlement or Judgment.

To Exclude Yourself from the Class

interesting. apparently someone has started a class action lawsuit against EA sports because they have exclusive license to all the major football leagues and think EA overcharged for the games in a monopolistic manner. You must have registered one of your games at some point and the lawsuit subpoena the records. Either that or it is spam...

going to the links and Google searching "class action lawsuit against electronic arts" show this to be legit...

Yeah something about when 2KSports brought out their games at $19.99 and $29.99 someone decided (and must have found something) to prove that paying $49.99 for Madden was too much.

The lawsuit is real though.

I knew I should've registered my games darn it! (I might have at one point but I'm sure I just ignored it).

I got this email also the other day. I don't remember registering for anything? Unless it takes your info from using Live or PSN.
I also highly doubt they will do anything to the millions of people who bought and own these games.

You would be surprised. Remember that class action lawsuit years ago about overcharging for compact discs? I got $10 from that.

I know for a fact that I did and haven't received anything yet.

Payout to people who bought Madden and NCAA, and forcing EA to reduce the price of the games probably.

I understand now, I didn't bother reading the entire email because I thought it was a scam or plain spam mail. I thought it was against the company AND people who bought the games. Nevermind I get it now:o

Exactly what I was thinking. I don't think there is a way to know that many people who own the games.

And the kicker for me was you had to buy it NEW to qualify. What's to say millions of people don't now go out, by a $2 copy of Madden 2005 and claim they're in? How can they possibly know if you bought it new or not without a receipt?

Also, like I said, I know FOR A FACT I should be part of this lawsuit and have not been contacted yet.

I do not have any receipts or anything to prove I ever purchased anything. Who the hell would keep receipts for video games and keep them for 5+ years? Only way I see them being able to know if you can be a part of this is via email registration.

If that's the case that sucks because I'm sure there are millions of people who:

A) Registered with an email address that is no longer valid
B) Will not get the email because it was filtered out by a Spam checker
C) Didn't register at all (I really don't find it necessary unless you're playing online and it's mandatory)

I remember for the CD lawsuit years ago they needed nothing from me and I didn't register anything from that.

I agree with you Zacky. I actually got the email in one of my old accounts I hardly ever check anymore. I can only assume I am linked into this via Madden 10, that is the only one I played online and would have actually registered. Oh, I guess I did recently register Madden 11, tho I bought that copy used. It would appear I am already a member of the lawsuit, and I would thus have to take action to exclude myself if I didn't want any part.

Funny you say that. We only got our Playstation 3 about a month or so ago. Up until then all I ever played was NFL2K3 on the Wii. Love the funk out of that game. :D

Hey, its some people sueing electronic arts because their running a monoply with the Madden franchise. Thier is no competition now, so every year Madden has gotton worse and worse. Back in 2005 when they got the exclusive NFL license their was another football game called NFL2K5 which was way better then madden and still is to this day and came out at a cheaper price.

Exactly , look at NBA2K11 by the same company. It was so good that EA decided not to release their shitty NBA live game this year or whatever you call it.

Last one I got was NBA 2K9 but I loved that compared to NBA Live. I also loved the shortlived "ESPN" franchise from 2004-2005 (Under 2KSports). I got NFL 2K5, NHL Hockey (I think it was 2004), College Basketball (2004) and NBA (2004 and 2K5). Loved 'em all, and they were bargains.

But they upcharged because they could (EA that is).

I live in a town of about 2500 and there's only one grocery store. 85% of their stuff is overpriced because they're taking advantage of being the only game in town. Luckily there's a better store just 10 miles away. :)!

I have bought Madden before and have a registered EA account fir my games. I didn't get this though. Maybe I should check my junk box.
