I opened an ebay case against a seller about a week ago because he sent a basic 35pt card in a toploader and sleeve and it arrived bent. Just based on experience I always put a thick decoy card with any card 75pt or smaller. I just play it safe to ensure no damage.
Well this guy responds confidently that he will issue only $10 refund($20 card) because its not his fault. He also stated that he feels I just want to back out of the deal. He also said that if i want to escalate this that he will fight it.
Of course knowing ebay they are going to side with me and I would get my money back.
Well as soon as I escalated the case, I instantly received a message saying ebay has sided with me. :)!
So my guess is ebay never reviews these cases and the system automatically sides with the buyer???

This is what the message states:
"We have decided to issue you a courtesy refund for this case on Sep 19, 2011 to the PayPal account you used to purchase this item."
It makes no mention of me having to return the card, so did the seller get the money deducted from his account or not?

I don't know if PayPal deducted money from the sellers account.
But I do know that PayPal will cover a claim themselves, and work on getting the money from the owing party on their own time, so as not to tie up the claimants money. It sounds like this is what happened with your claim?
If you don't send the card back, PayPal will notice (no DC# showing returned item), and the seller would not have to refund an item that was not returned.

But when I go to my paypal account there are no instructions anywhere that says I have so many days to return the card or anything?

The fact it says you received a courtesy refund basically means Paypal for some reason made a no fault ruling. You keep the card and the money. The seller keeps his money. I don't know why they would have made this ruling, but they did.
The seller saying he was going to fight it kinda makes me laugh though. If the card was damaged and you sent it back with dc, there would be nothing to fight. He would refund original price+ original shipping weather he wanted to or not.

I got a courtesy refund once when some HUGE seller only sent me 2 batteries when I ordered 3.
I filed a claim and Ebay sided with seller because some feces throwing chimp in their shipping department wrote "3" on the invoice but only sent 2.
I called ebay and complained and they gave me the whopping $6 refund without ever taking it from the seller.

Here is what he said exactly made me laugh:
""I will give you half your money back. I think that is more than fair. You say I did nothing to protect from bending, but it was in a hard case and penny sleeve and even in a bubble mailer. You said there was no creases but you know it happened during shipping. I am more than happy to escalate this to eBay customer support. But then I will fight for returning no money since you said in a previous message that you knew it happened during shipping. I have never had this issue before and I am not about to ruin my feedback because you want to back out of a deal. That is what this is feeling like. Let me know if interested in keeping the card and recieving half your money back. Otherwise go ahead and escalate this to eBay and we will handle things there."
by "hard case" he means toploader.
