Long story short, made an offer on this:

eBay - New & used electronics, cars, apparel, collectibles, sporting goods & more at low prices (http://www.ebay.com/itm/160660370128?ssPageName=STRK:MEWNX:IT&_trksid=p3984.m1439.l2649)

He accepts. I pay instantly as I always do. A little over a week later, this thing gets marked as "shipped"

About a week goes by and still no card.

I contact the seller asking when it was shipped:

Dear grant22584,I sent it out last Tuesday via USPS.- tutuchi

Instantly he replies after that saying:

Dear grant22584,hi , i braught it to my local ups store on the 13th it shipped out on friday the 14th so give until monday depending upon the mail being i'm from new jersey i'm really sorry about this i had a busy week so thats why it shipped out so late again i'm very sorry - tutuchi


So, I leave it lay. All the while thinking..."My address is a PO Box. How can he ship UPS?"


Now, I can't file a claim through ebay yet because it isn't the 29th. Estimated shipping is like 4-13 business days after receiving cleared payment. So I'm patiently waiting. My hands are tied til then so I don't really pursue anything.

Today he messages me:

Dear grant22584,hi did you get the harper because i have not heard back from you let me know- tutuchi

I reply:
Dear tutuchi,

Nope, and the way you structure your ebay auctions I have to
wait forever to open a claim.

He replies:

Dear grant22584,your full of crap you know you got that card now your trying to say you didn't you enjoy stealing from other people i went to the store and have the paper work that i sent it and you the card should have been there your trying to pull a robbery on me , it's a shame how you like to lie and steal from honest fair people..- tutuchi

I reply:

Dear tutuchi,Show me that you sent it. First you tell me you shipped on a Tuesday via USPS. Then you fire back saying you sent on a Friday via UPS. Which one is it? Where's my tracking info? How can UPS ship to a POST OFFICE BOX? I've had people ship me $1,000 cards with no tracking info and have always went out of my way to tell them to use proper tracking because there are dishonest people out there. I've never screwed anybody. I like how you try to pin blame on me. It's a good laugh.- grant22584


He replies:

Dear grant22584,get your facts right now you email days later saying you did not get the card when i emailed asking for a responce , good laugh no once a liar and a cheat always one i shipped it out from a ups store going regular mail so stop being a liar you know you got the harper and now you wanna steal a hard working person's money- tutuchi

I reply:
Dear tutuchi,I'm a hard working person as well, and I'm not deceitful. You can say whatever you want, that's fine. Do I appreciate it? No, but everybody is entitled to their opinion. If you did ship, you should be able to provide some kind of tracking info that guarantees you sent out. Why don't you take your "receipt" to the place you "shipped" and see if they can help you. The way I see it, I'm out the $98. Is that a lot of money? No. It's the priciple. I paid for something, I expect my card. Simple as that. As far as my facts being straight, they are. I paid for something, you haven't delivered.- grant22584

he replies:

Dear grant22584,ok you paid and you got a card i tried to work with you when this went down and got no help because you did not email when i asked after i responded now 3 weeks later you are complaining about not getting the card . my feed back is perfect because i take care of honest people , sorry if you can't sell it for a big profit just stop with the BS. you know you got that card - tutuchi


Now at this point, it appears as though things aren't going to get resolved. I just go straight through paypal instead of ebay buyer protection. I open a dispute, then instantly escalate to a claim.

A few hours go by, it's my turn to respond to the case and upload documentation. Documentation? Of what? I'm out $98. Upload a picture of my bank statement? I don't get it?

So I call paypal, I talk to a nice lady, read all the messages he sent me, then she updates the case and does the reversal. I'm a rookie at paypal disputes, as I haven't opened a claim since 2007. Luckily I haven't had to.

Then I get another message:

Dear grant22584,you stole my card i will be going to my local authorities and file charges on you for theft you know you got the card - tutuchi

I reply:
Dear tutuchi,It's impossible to steal something that I never received. - grant22584

he replies:
Dear grant22584,forget it i resolved it with paypal you got your money , i really sent the card i can even email you a copy of the paper work . one thing check your post office it was not in a envelope i had put it in a small cell phone box maybe it could not fit in your post office box ... sorry for the problem- tutuchi


So that's that. But the thing with me is I'm the most straight up guy you'll ever meet. I'm not dishonest, and it just irks me that people resort to those things. If the guy hadn't been such an #@#@#@#@#@#@#@ and accused me of being a thief, I would've been more patient and apt to work with the guy. Let it ride out until the 29th. Give him the benefit of the doubt. But it was instant attack mode on his part, so I expedited the process. I hope the guy did ship, because if I ever receive this card (Not holding my breath), I'd contact him instantly to pay him. I'm that type of guy. Even if paypal ruled in my favor, then I got the card a month later, I'd still pay him for it. I sleep well at night knowing I don't screw anybody.

What is sad is that it could actually be lost in the mail. That would suck.

You are one of the better people here, so I'm assuming you would be on the Bay, too. It sucks that people (Like you said) go straight to attack mode. I'd be angry too because I don't like to be called a "scammer" or anything of the sort. I know I would never do that, so I don't understand why people would think I would. I have never been put into this situation, but I can imagine how stressful it can be. I'm glad you got your refund, and even glad(der?) you would go out of your way to pay the guy back. That's huge right there.

Glad everything worked out for you, man.

This guy just messaged me about ending an auction early offered me a really low offer and got mad when i said no to ending the auction and that the card would go for more than that....what a TOOL

I clicked the Ebay link before I read the story and as soon as I saw the price it sold for I didn't need to read the rest. He says he has proof but won't share it, me thinks he is mad after he realized he undersold that card by about $60-$70.
