Bought a card of eBay and received a bubble mailer containing a blank decoy in a top loader. And of course there's DC. Filed "item not as described" with eBay and the seller stated he did send the card. Please tell me how this is going to end?!

Ouch...if he had DC, probably not well (for you). I've almost started to video tape any high end card openings that I get in the mail for reasons like this. I know it probably won't matter to ebay but at least I'll have proof. Sorry about that man.

eBay sides with the buyers most of the time--you should be fine.

Let us know who the seller is though after this gets resolved.

yea you should be covered... ebay and paypal get this all the time... thats why u dont buy from anyone who doesnt offer refund...

I disagree. There are more dishonest buyers out there than dishonest sellers. Sportscards are a constant fluctuating market. It's very easy for a buyer to spend $100 on a card of Player X then Player X breaks his leg and the buyer sends it back.

Sure, 1 in a million seller is a putz, but ebay already protects you from such putzes.

I had a guy on a $3 card email me the day it shipped that it didn't arrive and he wanted a refund. Of course after waiting 3 weeks, the card never showed. Hmmmm...that was before DC was required the way it is now and before paypal was offering DC discounts.

Yes, on a $3 card...

You did EXACTLY the right thing. File an item not as described. Return the same exact decoy in the same exact top loader. Use DC# when returning. You will get a refund and eBay buyer protection will force the refund if the seller fights it.

I dont offer refunds and this is something I would never do to someone!
plus if you really wanted a refund for a good reason I would prob. let you return it anyways.

you should def. tell us what seller this is to warn other member's.

You still have the right to return anything as "item not described." That's why it makes no sense to offer a return policy. This tells the buyer it's okay to return an item for any reason (which it isn't for sportscards). Granted most experienced people on ebay know this already, but the 0 feedback types probably don't so why help them burn you?

You can get any card in the mail, if it is not as the seller described you can return it. Say it has a dinged corner the seller did not describe or something, that is not as described. That is why ebay states the seller is liable for describing their item accurately. A dummy card is not as described..easy win for the buyer...:)!

Yeah, I sent him an email saying if this isn't resolved then I'm posting his eBay ID on all the forum boards. I also gave him benefit of the doubt - in case he thought he mailed the card but "accidentally" left it out - to fix the issue and just get the card to me. The jerk writes back telling me I'm trying to pull a scam him if I post anything negative about him he'll hire a lawyer and sue me for libel.

I've been buying cards off eBay for years and this has NEVER happened to me! I have only filed one case prior to this for non-receipt of goods (which was for a $4 card); I would never try to scam anyone. I'm insulted and upset by this turn of events.

Has this ever happened to anyone else?

because "item was not as described" thats why. buyer WILL win.

as far as acepting or not accepting returns it makes no difference. if buyer claims an empty package, damaged card, wrong card, whatever, the not accepting returns idea is thrown out the window...

Ya eBay sucks... I recently had a bad experience as well as a guy bought my nt cam rpa for 1800... Then after 3 weeks of obviously trying to flip... He returns as "damaged". I already spent the money and the market dropped(hence why he couldn't flip) so basically I'm totally screwed.. Did I mention I hate eBay???

This is one reason I would like to move towards selling all graded cards. Buyer pays 1800 for that card. Then overnights it, 2 day service to beckett min grade bgs 9.5...card meets he is golden, it doesn't he returns. Very easy to do with the 14 day return BS on ebay now as well and paypal allowing 45 days and chargebacks 90 days, very tough for sellers on high end items.

I would like to see ebay make it mandatory that all buyers must leave feedback within 48 hours of delivery confirmation/signature confirmation shows package was delivered. That would put a stop to this non sense, once feedback has been left transaction is final...

And please post the ID of this person for our protection...thanks and sorry that happened

Be careful on how you word your email back to the seller. If he wants he can now use that against you for feedback extortion. Just file the police report that ebay will ask for and submit the info to ebay so you can get your money back.

At least since last December when I got a one touch with no card in it. The card was over 300, and I would assume that it is required for cards over 250.
