Here is the story. I listed a 2012 Bowman Chrome Robert Griffin III auto rc for $799.99 at the time it was the only one on eBay. This buyer offered $450.00 an offer that I accepted. The next day he mssgd me saying " I forgot that my mortgage was due, I can't pay for a little over a week, if you want you can cancel the transaction". I opted to wait for payment, which came in about a week after auction end. I mailed he card out ASAP. Today he mssgs me and says that the card has a chip in the corner (which I KNOW is BS).he immediately opens a claim and asks for a full or partial refund. I offer a partial refund of $50.00 which he immediately declines and then mssgs me "I'm ok on the $50.00 I'll just take a full refund I'll mail he card out in the 12th". I then mssg him that I have an exact copyof the card that's know is in mint conditn cause I'm staring right at it that I will gladly exchange for the "damaged" card. He also declines that offer.
To me is sounds like buyers remorse and I stand to lose $100-$200 based on current mv.
Any thoughts, suggestions?.

Welcome to the world of eBay. Sellers are held to a 45 day return policy. Buyers can speculate and invest on your dime. Its a joke, it really is.

Id just take the card back, hope he doesnt damage it himself to validate his argument, then re sell it. Not worth dealing with him or giving him a partial

Not sure I've been throug this before so question : he escalated to a claim and eBay will respond in72 hours. Assuming the will find in his favor will they automatically fprefund the money or require proof that he sends the card back first?

I'm trying to get him to send a scan of the card and he is giving me a really hard time and he wants me to pay for shipping the card back to me.

I would ask him to return the card, once you receive it you will refund him in full. That is all you have, either that or fight it and get a negative.
Selling high end 400+ cards on ebay raw is becoming harder and harder. Whether you like grading or not it takes this type of BS and puts it to rest.
I also have noticed a lot of sellers just putting their bottom dollar on it and having immediate payment required checked...

Have you heard of the investing on someone elses dime scam yet? Ebay says you have a 14 day return policy but technically you have 45 days, the time allowed for a claim to be filed. When a player has a big game (football, I am talking about) someone will buy a nice copy of a card from that player from you and hope that the player has a few more good games in a row and the card increases in value. If the player performs well then you will have no problem because your buyer will just sell the card and make a profit as this was his goal from the beginning. But, if the player only has the one good game and tanks in the next few weeks your buyer will send the card back saying it had a scaratch on it that they did not notice before or something along those lines and you are on the hook for a refund and there is nothing you can do about it. No risk at all for the investor. That is beyond BS.

You could compare autos of the two and show them to ebay/paypal...doubt it would do much, but maybe 1 out of 1,000 chance it would work

I called eBay customer service a few hours ago and explained this whole situation to them. The person on the phone reviewed the transaction, emails and claims bathe buyer made and basically said this:
Since the buyer escalated the claim you kinda have to wait at this point. eBay will make a decision in up to 72 hours. If eBay rules in the buyers favor then the money will only be refunded when the item is returned to me in the same condition that I mailed it out in baSed on original scan from listing and a scan that I am to provide at the time of reciept. At that point the case will be closed and I will have card and buyer his money back. However I can appeal this ruling. And these are the paraphrased words of the eBay person " Since he citing a specific chip in the card and i cannot see a chip on your scan this looks to be a case of buyers remorse and you would have a strong case for an appeal at which point eBay would refund me the money".
Not sure how much stock to up into this but, this is the most buyer friendly thing I've EVER heard from eBay regarding a case like this.
Thoughts?

I just got this message from the buyer. Could he be building any better of a case of buyers remorse? By the way there is NO chip,on the card I sent him.

Video tape the opening of the package. Stick it to this guy. I've never had anything like that happen but things like this are why I stopped dealing on eBay a few years ago

You dont have to videotape anything. If you get back an empty package you appeal the dispute. Ebay makes you fax a copy of a police report stating what happened and then ebay will refund/repay you.

ROFL!!!!! What does selling one for $299 have anything to do with the one he agreed to buy for $450? People's logic seems quite off recently.

Yeah, my thoughts exactly. Actually if this does not go my way look for a huge dump of cards from me and I am OUT! I'm so sick of EBay not policing the buyers and just screwing the sellers. I spend a $1000.00/ month on listing, fvf, PayPal etc and they could care less.

Technically if he really wanted to, he could send you an empty bubble mailer with tracking number and just put a piece of paper or something in it to give it some weight then ebay/paypal would still force you to give him a refund once they see that it was delivered with the tracking number. Then he could get the card and the money but lets hope he isn't that bad of a person. You can message ebay/paypal all day long saying he sent you a piece of paper but they ALWAYS will side with the buyer. And the police report thing how can they prove that you really received an empty package or that you are really the person that is trying to do the scamming ? It is possible that you could get the card back, then say the buyer sent you an empty package and try to get your money back. It is really a corrupt system and complete BS. The scamming could really work either way in this situation and there is no way to have proof with either side its all just words. The only proof (that ebay can see and will recognize) is the tracking number that says the package is delivered whether it has something in it or not can't really be proved. I guess unless you video taped the mailman putting it in your mailbox and then you open it on camera. But even then you could potentially cut and edit the video to put whatever you want in there so i don't know that a video recording would even work in this situation. You would have to call an ebay rep to come to your house before the mail gets there and have them watch you get the package and open it i guess. I know you would never scam anyone but what I'm saying is that this is how outsiders view it. Really impossible to prove either way.

Just an update, the buyer returned the card.. In perfect shae, no ding dent or anything. I contacted EBay to apples the case and they basically said " you got the card back didn't you?". I pm pretty pissed right now, not sure what I'm gonna do. Part of me wants to say f-it I'm dne with eBay and just dump all of my crap and be done with all of this crap. And part of me says out of 8000 or so transactions something like this is bound to happen, just shut up and move on. Thoughts?

I have been on ebay since 1999 and can count on my hands the number of crappy stuff like this happening to me. One of these happened to me last year. One thing I do before I accept any offer is I see the feedback for the person, but also see the feedback they leave for others. If they seem reasonable they probably are.

I did check his feedback prior to the transaction and it was very clean.

That does not prove anything. How do they know that you did not make a fake package up and stick it in your mailbox before you started recording? Thats why paypal or ebay wont look at any video.
