Hey guys okay here is the deal I sold a 1/1 longevity of Troy Smith a beauty of a Ravens patch some of you here may have seen it. Anyway I list it with a scan front and back of card. Even put a phrase all cards in great condition unless otherwise noted. (this helps me to be aware of the product and any flaws that may earn me a ticked off buyer.) Now, I look the card over again before I mail it in a 1/4" card sleeve w/ team bag and bubble mailer. Insured with D/C to cover my @#!. Now I get an email from this guy.
Dear fstpitch12,
I just received my card and there's a scratch in the back of the card that wasn't showing on the scan and there was nothing on the discribtion stating any damage. Is an half an inch scrath and I am not pleased with it. I will like to return the item and get a refund. You can check that I'm a good ebayer. I've bought many cards on ebay and never had this problem.

Where is a Seller protection? I did everything right and I have very good feedback on ebay selling a lot of cards. Now I am out 207.00 & a nice card.
I am positive there were no scratches on this card.
I contacted Ebay and they are still probably scratching heads wondering how to respond.
any advice?
Email #2
Dear fstpitch12,
I bought that card for a client of mine and now I'm stoke with it. It's not worth my time waiting for Ebay or sending it to dunruss for a $200 card. You should have sent the card on a screw down to prevent damamge during shipping. That seems only right when you sell a card of such value.

First of all do you have a return policy listed in your auctions? Second thing I'd ask this guy to email you a scan of the problem he is complaining about and tell him there were no scratches on the card when you sent it and ask if he thinks this was damaged in shipping. If so then he needs to go to the Post Office and file a claim as you sent it with insurance for just this reason and the recipient is resonsible for filing the claim. If he is just having buyers remorse then I would stand pat as I dont see where he can win a claim against you. The not as described issues are handled much different than not received. He can also see that you are a good seller and was not being deceptive about the card condition.

How are you out the card and the money? Didn't he say he would like to return the card to you for a refund?

No return policy. I will email him but, I am not sure the PostOffice will do anything about damage if there is no damage to the mailer. I also suggested to send the card into Donruss it's a recent product. They should replace it.

I might mention to the buyer that you did purchase insurance for the card (as a courtesy) and that a claim can be filed with the USPS if there is in fact damage due to shipping. I'd go with the suggestion of requesting a scan of the card to see what exactly the buyer is talking about and if it does look like there is some damage then you can proceed with filing a claim with the post office. I'm not sure how long it would take the post office to resolve the issue, but at least that way neither of you would come out with the short end of the stick. :)
(All of what Chucky said lol)

To file a claim, he'll need the original envelope with the insurance sticker attached.

Yes and make it clear that it is the recipients responsibility to file the claim as the Post Office wants to inspect the damage- envelope, all packaging and the card.

I'm not sure if I missed it, but did the buyer use PayPal?

The only think that makes me laugh more than people that spell it Dunruss are the people that pronounce it that way too. A close second are the people that spell it as two words.
Not trying to make light of your situation. Honestly, PayPal may screw you here. All you can do is provide the information and hope. The recipient definitely has to file the insurance claim, though. It is a hassle, and that could be what turns him toward just complaining to PayPal instead. This type of problem is part and parcel with selling on eBay, and it's a crying shame.
If you lose out and get the damaged card back because he won't file a claim with the USPS, I guess you could try returning it to Donruss yourself.
But if nothing else, this should prove that "eBay Seller Protection" is a misnomer. There's really no such thing.
