Top Yankee prospect was arrested early Thursday morning for misdemeanor DUI. Such a shame.

Should be a 50 game suspension, just like the drug policy.

Mehhh not that big a deal IMO if he didn't fail the breathalyzer and they had to make him do the field test where it's a judgement call rather than a set in stone determination. Sounds to me like some cop had a axe to grind or was behind in their monthly arrest quota.

That is a embarrassing comment. Excusing a DUI without even a lick of knowledge on the situation.
If you had a loved one that was killed by someone who was driving drunk, you would never make such a foolish statement. Shame on you.

Except by legal standards aka The Breathalyzer he wasn't drunk he blew a .006 and the limit there is .008 which is lower than the .10 most places have. So anywhere else he woldn't have even been close on a breathalyzer. He was only detained because of a judgement call on a field test.

if a DUI driver crashed into a loved one of yours, you would change your opinion on this.

No because that person would be actually drunk

I think his point is that a driver with a BAC of .006 isn't a DUI driver.

It doesn't matter if he was legally drunk or not. He drank and got behind the wheel and was caught.
Don't drink and then drive period. It's really not that hard to understand.

All 50 states have now set .08% BAC, commercial drivers .04%.

and if you're under 21 years of age, .01% BAC or higher is an automatic DUI

You obviously are ignorant when it comes to blood alcohol levels. I have seen people blow a .03 and not be able to stand up. I have also seen someone blow a .34 and never slur a single word. It is dispicable that people defend the scum who choose to have a good time and put peoples lives on the line (probably means you do it). We can continue this conversation when your mother gets killed by a drunk driver who blew a .05.

Justify your idiocracy all you want, the kid was pulled over for SWERVING into another lane at 3am after he was drinking.
Whether or not he was under the legal limit is of no consequence here. It's obvious the alcohol impaired his ability to operate the vehicle and he should consider himself one lucky SOB.
Rather than suggest this police officer had "an axe to grind" or "a quota", how about a little props for giving an unsafe driver a very necessary wake up call.

You can judge him on a moral level if you want but technically he wasn't break any laws. That's just a fact you can choose to accept or not.
People swerve on the road for reasons other than being drunk. Sometimes they are messing with the radio or talking on the phone or maybe they drop something and are trying to pick it up. None of those reasons are good ones but just saying just because someone has been drinking and are seen swerving doesn't automatically mean they are drunk especially when the legal device that's used to determine just that says they aren't.
Anywho no point in arguing about it so we'll agree to disagree

So if someone in your family was killed by someone driving who blew a .0799 it wouldn't bother you because the law is .08?

I'm not arguing the facts, I'm arguing your "no big deal" assinine attitude towards the news.
This is a big deal / a HUGE deal and if Mason does not recognize the severity of what he's done (and could have done) then shame on him as well.
Stop defending the guy and make him accountable for his actions.

If anyone should have got 50 games, it's Yovani Gallardo at 0.22 and he weights 50 pounds more.
From the sounds of it he should not of been driving even if he was under the limit.

It shouldn't matter. Lets say two MLB players get busted for roids. Should one player get a longer suspension than the other player because he put the needle in his butt more times? The way I see it, the amount should not matter.
*the following is not directed at the person I quoted, but at the guy who is defending these actions, and probably his own.
Hypothetical Question
Lets say it is ok to drink and drive after a beer or two. Is that amount ok for anyone? Does a 300lb man not differ from a 110lb woman?
Secondly, lets say it is ok, no matter what to drink and drive at .05. How do you know you are at the level? Do these people go and get tested to see how much their body can handle before it reaches that level? Or do you think that maybe they just drink and drive and hope for the best if they get pulled over? Do you think they are sweating when they blow into the field test? I would say yes. If they are, I would assume that they knew they were doing something they shouldn't have done and are worried about their alcohol levels.
I believe that the drinking and driving laws should as strict as any law on the books. So many crimes hurt no one but the criminal or property. What we are talking about here is innocent people who have no choice. They cannot keep these pieces of garbage off the road.
How about a little boy who just hit his first homerun at his little league game. His mom gets him loaded up in his car and the boy is so excited to run home and tell his dad what he did. Dad was working late so he couldn't go. On the way home one of these idiots swerve into the other lane and hit them head-on. The mom and boy are both killed. Are there seriously people who defend those actions and think there is nothing wrong with it? Seriously? Seriously? I honestly cannot see any way in this world that anyone could have that opinion without having mental issues. And I am being serious. There is something wrong.

Technically, he is innocent until proven guilty. This is why they tell players to refuse to take a breathalyzer. There is a good chance that by the time they are arrested and forced to take a test they could blow a substantially lower level. So he gets pulled over under suspicion of DUI. He refuses the test, and the officers arrest him. He can argue against it in court and get off because the evidence against him is subjective.
With that being said, the Yankees should suspend him internally and set a precedent that this crap won't be tolerated. Just because you are able to get away with it doesn't mean you should be doing it.

I am not sure about your state, but in North Carolina we have a thing called implied concent. When you get your drivers license you are consenting to the test in the field. If you refuse the test you are admitting guilt.
Also, if you refuse all they do is take you to the hospital and have your blood drawn. Your levels do not drop in your blood like they do on your breath.

The implied consent is why you are automatically arrested if you refuse the test. I don't know of any states that don't have this law. The levels drop over time, whether you do a blood test or a breathalyzer. By refusing the test you are rolling the dice on your body metabolizing enough of the alcohol that you will be under legal limits by the time they are able to test you. This time-frame can vary too.
Of course if you are Miggy or Joba drunk there is no point in even trying because no one can metablolize that much alcohol in an hour or two. Either way you just should not get behind the wheel after drinking.
