This wonderful seller is currently offering Walking Dead Season 3 boxes on eBay. I purchased some. A few minutes later I get an invoice for payment. Mind you, this product is not scheduled to be released until December 4th at the earliest. Who in their right mind would pay someone on eBay 3 months in advance when eBay only allows you protection for 45 days from the sale date. Just wanted to let everyone know, stay away from this scumbag. Our conversation is below. Starting from bottom to top.

Dear dreamjoey,

Oh, I'm so hurt.

If you want to sell presale items, be sure to meet all of the following criteria:

Guarantee that the item will be available for shipping within 30 days from the purchase date. Be sure to clearly state this information in your listing.

Make sure your listing follows these guidelines. If it doesn't, it may be removed, and you may be subject to a range of other actions, including limits of your buying and selling privileges and suspension of your account.

Dear dreamjoey,

Please do that. I'm sure eBay is going to side with me on not paying for something that I will not receive for 3+ months and that payment requirements were not stated within the auction.

Dear yorkbag,

We will not cancel any ebay transaction. If you refuse to pay this item then we will open the case against you.

Thank you,

Dear dreamjoey,

You can cancel the order and send me a cancellation request and I will oblige so you receive your final fee credit.

Dear yorkbag,

You should know better before you order. I didn't ask for any deposit and we are required to receive all payments in full after order. Your payment due is this Friday.

Thank you,

Craig

Dear dreamjoey,

Maybe I'm missing something, but the auction never stated that. It seems a bit odd to send that much money 3 months in advance. If something went wrong I would be long out of buyer protection. I completely understand a deposit, but the entire amount now makes me a bit uncomfortable. I am a power seller and frequent buyer on eBay and have never had this issue before.

We must receive all payments in 2 days after order for confirmation.

Please advise

Dear dreamjoey,

Greetings. Thank you for accepting my offers. I see I have received an invoice for the case. I'd prefer to pay a bit closer to the release date. When I order cases from retailers it is always a deposit and then balance due 2 weeks before release. Please advise. Thank you and have a great day.

Seems to me that they are clearly in violation of criteria #1

Also, found this in another forum from 2010. So, glad I did not send payment.

I just got taken on a pre-sale from a 'dreamjoey' big time ebay seller. Was not Topps stuff though. Thought the new non sport AC/DC Press Pass stuff looked quite cool. Did the pre-sale purchase for a box in Oct for a Nov release date. Press Pass delayed the release date, still not released, and the 'dreamjoey' seller refuses to refund. Have written it off as a loss. The bad thing is I am no longer able to leave a neg , or, submit a paypal or ebay dispute due to it being 60 days since purchased. The seller knew what they were doing when sending me assurances the product would be shipped a few times. Never again will do a pre-sale.. Sucks because pre-sales do at times get stuff cheaper if the product takes off later.

Literally no one on eBay follows these guidelines:

""Guarantee that the item will be available for shipping within 30 days from the purchase date. Be sure to clearly state this information in your listing."

"The handling time specified in your listing should reflect the time from the end of the listing until the item is shipped to the buyer—not the time the item is in your possession. Be sure to specify the correct handling time in your listing.""

Come on eBay...

This guy has now changed his listing to state that "THE ITEM WILL BE SHIPPED BY THE 30TH DAY FROM THE DATE OF PURCHASE." I sent him a question asking how it's possible to ship by the 30th day when the product isn't even released for almost 90 days. We'll see what he says.

Well, at least he read my reply containing the link to pre-sale listing rules. He has yet to file a non-paying bidder case on me as of yet. Please do keep me posted as to what he replies....

Be sure to also bring up the handling time if he doesn't cancel it. That's also wrong per the eBay pre-sale rules.

I guess I have a couple questions. Why didn't you send him a message regarding the item prior to purchase? Why did you assume you wouldn't have to pay up front? A simple message via the "Questions" option would have prevented all of this.

I had something sort of similar happen with Sadie2307 on ebay. Only I waited to buy a presale until 3 weeks prior to release, so I would be protected within the 45 day dispute deadline. Others were not so lucky and ordered months in advance. She decided to take the money and run. I was protected and was refunded immediately. Others were not so lucky.

I assumed due to eBay rules and dealings in the past that full payment would not be required 3+ months in advance. I've never had the issue before when purchasing pre-sale items way in advance from other eBay sellers. He is the first.

would u be protected if use a credit card?

their protection is a lot longer than the time frame pp gives a buyer

i know discover card was helpful .. though this was a year or so ago and things may be different now

I always use a credit or charge card for all eBay and/or online purchases over $20. It has saved my behind many times. I know AMEX has a three month dispute policy, six if you press them but not guaranteed. Discover has an 18 month dispute policy and that is the one I mostly use. :)

I remember Sadie2307, great seller, until she decided to run with the money after she built a reputation. I got my refund but only because I was within the 45 days. Held up my money for around 2 months, nice way to take out an interest free loan.

Used to buy from this guy back when I started buying boxes. Not a very reliable person, and therefore stopped buying from him after I stumbled on this site called Blowoutcards :)

Still no response from the seller, but his Walking Dead presale listings have been removed.

Yes, I was on the phone with eBay last night for almost an hour. :)

Why don't you just pay and wait a week then file a claim? Get your money back and can leave a neg.
