I have a current paypal resolution case up that has now been escalated for a paypal decision. I am the seller. Buyer is requesting a refund. Card in question is a 1996-97 Kobe Bryant EX-2000 Credentials graded BGS 8.

Price tag: More than $800 less than $1000

Summary of buyer's argument: "card arrived safely, no damage to BGS case, but I measured the card and it appears a little shorter on one side. The grader made a mistake."

Summary of my argument: "you bought a graded card; you saw large pictures of the card, card arrived completely undamaged; the case is undamaged; you got exactly what you paid for."

The prevailing thought on blowout is that ebay and paypal ALWAYS side with the buyer. I think I presented a good case to paypal, but no doubt I am the underdog. Can I pull off the upset? Will justice rule for sellers everywhere? Make your opinion known!

UPDATE: 5/24 Message from paypal:

"Dear (my name),

The following case was found in your favor. Any hold on this transaction has been removed."

That's what I'm talking about...score one for sellers everywhere!

wow...yes let's hold the seller responsible for somebody else's supposed screw-up. I sure as heck hope you win if the above is all true. It's a mad mad mad mad world.

Ridiculous. You should win this 100 out of a 100 times, but who knows? He paid for a BGS 8 and got a BGS 8.

Are you serious? The buyer is mad because he went beyond what the grader did to measure it himself!? :doh:

I know, that's what everyone always says - I think this will be a good test case. The odds are not in my favor.

My guess would be that the buyer loses the INAD case, but returns it anyhow under some other façade of a lie.


So you win the case, he still gets his money back.

Just take the return back, paypal almost always sides with a buyer that has remorse

the buyer loses because he said card arrived safely and the BGS Case is intact, him measuring the card isn't a good excuse when the card is graded

Yeah, I usually do but feel in this case I'm fighting just for the principle of the matter. It's not about the money (as I will have no problem re-selling the card) but stuff like this just bothers me.

I had to accept a return last year bc a buyer didn't believe the card deserved the grade it received. Good times..

Bad news OP,

Not only will you lose, but you'll only get your final value fee back if you call and explain the situation. About 2 years ago I had a buyer claim that the condition wasn't what he expected - also graded - I explained the situation through the dispute process. In the end, the refund was given to the buyer and I noticed the $60 fee was still there.

After contacting ebay. And calling them out in this practice, they explained that the fee is not removed as a policy to ensure sellers be honest with their buyers. The ebay rep removed the fee, but only after a half an hour of my time.

One of the many - MANY - issues with ebay.

I don't think this sale was completed on ebay. I think I saw a thread on this card in the FS/FT forum or perhaps a direct deal off-ebay was done.

To OP, I think they will ultimately side with the buyer and you will have to accept the return. I have a feeling this is basically just buyer's remorse or perhaps he found one for less.

I won as a seller when the buyer sent me back a fake card and tried to keep the real one for himself. It can happen.

You should talk to paypal directly on the phone. You need to explain that the return is unreasonable as you are not the grader. The card was grader 10+ years ago. It is up to the buyer to contract BGS if he believes the grade should be lower.

Second, you should demand that you paid shipping with buyer's money. It is unfair for you to eat the shipping cost due to unreasonable buyer's demand.

Third, you tell Paypal that trading card is event sensitive. When Kobe announced the retirement, his price was at the highest. Today, retired Kobe does not demand as much as couple month before. You should find some proofs to show that Kobe's price is lower in May than in Feb.

Lastly, you need to be professional at all time. Cursing or making joke on the client (even though he/she is unreasonable) is not necessary.

Btw I'd Probly be a buyer at the price you sold it for so you have that going for you if it gets returned.

I had the exact thing happen to me with a BGS 9.5/10 Auto grade card. Guy wanted a refund, I called ebay and they told me it being graded meant nothing if the guy didn't believe the grade it wasn't as described as far as they were concerned. Long story short, the guy sent the card to be regraded. Had the card came back worse I would have HAD to take a return. Even if the card wasn't as I sent it (meaning in a new case). That came straight from ebay's mouth. It probably caries to who you talk to but its what happened in my case. For those wondering it was a 2007 Bowman Chrome Auto Tim Lincecum BGS 9.5/10 Rookie.

Yeah I was about to say that if he lost it would be plain robbery in daylight with sodomy in action.

I know ebay has ruled on some effed up s.h.i.t, but how can you give the buyer the right to claim a refund because he measured the card himself and disagreed with a grading company which has no relation to what he bought since the card is the exact same thing he saw in the description when he bought it. Plus he even said the card arrived safely with no damage!!!
