Lawsuit is against Panini, not Topps.

Also this collector has no shot of winning the lawsuit.

Interesting. He filed vs Panini only and not Topps. Panini is much better about redemptions than Topps is.

Cool! It looks like my 5 year old pending redemption puts me right in the thick of this thing. For damages, I’m going to ask to be First In Line for all First Off The Line. And a pony.

I disagree. Not all claims will qualify for class treatment. Some claims will fail. But this is a legitimate, well-structured suit.

The article does an OK,but not great, job of summarizing the actual complaint. Although some claims are broader and potentially more significant, it's paragraphs 10-11 that make me shrug and wonder if Lionel Hutz is general counsel for Panini.

Paragraphs 10-11

In fact, Panini’s failure to honor its redemption process has been reported to the Better Business Bureau (hereinafter “BBB”) on multiple occasions and some 185 complaints have been filed. BBB has given Panini an F rating on its scorecard.


It is nearly impossible to contact Panini through any means, including telephone, emails, posts, etc. This has also been noted on BBB’s website, which reads:
“On November 22, 2017, BBB notified Panini America, Inc. that BBB has identified concerning patterns in consumer complaints alleging Panini America, Inc. fails to honor the promised fulfillment and delivery of products after receiving redemption cards from its customers. Consumers also allege Panini America, Inc. fails to communicate redemption order status, and fails to respond to emails and telephone calls.
BBB requested Panini America, Inc.’s voluntary cooperation in eliminating the identified patterns in consumer complaints.

As of December 27, 2017, Panini America, Inc. has failed to respond.”

Someone finally followed through so we have a real lawsuit not just a threatened lawsuite. Will be very interested in Panini’s response to this.
Any lawyers know if this type of suit can be settled by the plaintiff before other class members get involved? Can imagine Panini would prefer to buy him off with a couple of high value autos.

Smart. Before the Supreme Court changed laws about patent lawsuits, everyone would file in this one Texas county, because like 80% of the patent lawsuits got accepted to go to trial vs 20% in other county's.

One problem with the lawsuit: they spelled it panini and not poopini

Other than that, It looks good to me...

ill take points that dont expire over redemptions that do. Not sure what to do about the super rare stuff though. Or what happens if the hottest rookie doesnt sign the cards in time.

I have an Adrian Rondon Elite Green Auto still pending from 2014. Haven’t bothered to ask for a replacement because it hasn’t had value in years.

Panini accepts expired redemptions.

Topps does not.

UD supposedly accepts them for one year past expirations.

1 thing is Panini asks us how long we want to wait but they never send us anything after the waiting period unless we ask for it.

If he wants to settle his own claims, he can do it without affecting anyone else. But if/when a class is eventually certified, that's no longer possible. The court would then have to hold hearings to determine if the proposed settlement is fair, adequate and reasonable, and not based on collusion, for it to be binding on the class members.

This isn't a patent case; the TC Heartland decision is irrelevant to plaintiffs' venue choice.

This lawsuit depends upon State law. Unless the case turns on some federal procedural or jurisdictional issue, the SCOTUS will not (and cannot) hear this case.
