I'm glad BGS went further downhill after the Black Label scandal came to light. They were already treating customers badly. They've proven to be a poorly run company. And they handled the scandal terribly--basically never acknowledging that anything wrong had happened or doing anything meaningful to fix it. It's disappointing to see this recent run of suspicious grades, but hopefully it's just a one-off scam and not the return of a trend.
Back when I started this thread, I talked to some attorneys about it. All seemed to think that there was a possible class action lawsuit based on BGS telling customers they were grading one way, and then quite obviously not applying the same standard to Joe Clemons/Brian Gray.
But it's one thing to catch someone committing fraud. It's another to find an attorney to take the case on, find a plaintiff who is willing to move forward with it, etc. I will say, if BGS ever got mixed up in a court case of any kind , it would be fascinating to see depositions of BGS employees who were asked about this mess under oath.
