I had the worst thing happen to me regarding someone on eBay. I got a coupon code where I could list 1 item a day for 7 days with 0 seller fees going to eBay.... so I decided to sell a few things. I sold a 1972 Topps Baseball Complete Set that me and a buddy put together. It was in great shape. I plucked out cards and replaced with better ones. Some were off center, but they all had sharp corners and surfaces were great. The set sold for $911.01 which I was happy with. I packaged it extremely well and shipped to the winner via Priority mail. It arrived at the buyer's place 2 days later and he immediately filed a complaint on eBay against me, saying he wants a full refund, and cards were not as described. He said all the good cards were creased. (there wasn't a single card in the set that had a crease.)
Since I'm the seller, and I have no recourse, I had to offer him a refund after he shipped the set back to me. As I go through it, the good cards seemed to be the ones I shipped him. However, this dirtbag stole a ton of common and high number cards and replaced them with lower grade cards, creased, water damaged. And what can I do? NOTHING! because where's the proof? It's my word against his. So in all he gets all of his money back and he gets to upgrade his 72 set by stealing my cards.

Call eBay and explain the situation, you didn't get back same cards, they were switched out. Don't let a POS get away with this. If its a trend and others call eBay you might have some recourse or at the least help prevent more. I'm sorry this happened to you.

Looks like he is selling lots of 72s, stars & highs. Buy them pull your cards then file a claim against him.
EDIT: Nordy beat me to it , but this might be your best recourse.

This is wise. Don't let him get away with it. This is theft. You could even let him know that filing charges against him is an option. Anything that is $500+ is a felony. And if he used the US mail to commit fraud, it's a federal offense. I'd call eBay and let them know what happened, and then seriously consider sending him an email using all kinds of big legal-type words, scare the bejeezus out of him if nothing else.

Man this sucks to hear. I am sure with a lot that big you probably didnt have anywhere close to every card scanned that you could show the card that you had was replaced. As others have said I would fight this tooth and nail. Maybe report it to the local police and to USPS as it could be mail fraud. Maybe also contact other sellers that he recently bought from and see if he did the same thing to them or not. Hope you can catch this sleeze

Sure, the OP could do all these things you guys are talking about, but the burden of proof is on him. I doubt he could entertain thoughts of winning anything without extreme documentation of the minutia that no one ever does in a card transaction. Even if he could, it would likely cost him far more than he would ever recover in court.

Honestly man, we're talking close to a $1000 stolen from you. In Iowa, this is classified as an Aggravated Misdemeanor Theft which carries up to two years prison time. If he had stolen over $1000, it'd be a felony. Contact Ebay by phone and save all correspondence and evidence. Let them know that if the situation can't be resolved, you'll be pressing charges. There's no reason you can't get your money back if you're willing to work for it.

eBay does not stipulate that you need to offer a refund UNLESS the product is returned to you in it's original condition. What should have happened is you holding both his cards and money, escalating the case to eBay customer support, and allowing them to be the "judge". Even if eBay sided with him, at least you tried. It sounds to me like you just gave in with a refund and lost any recourse that you did have. Lesson learned. In the future, always use eBay to resolve major disputes like this. You may have even won the case.

There is no way in hell that I would take this!! If you completed a transaction with him, can't you get his phone number from ebay. I would definitely post stuff on his wife's facebook wall about what a fat lowlife this guy is to start. There is also no doubt that at some point in time, I would win a big ticket item of his and screw him over.

Had a friend do this to me back in college. Flooded my main email like crazy with gay website ads and magazine offers. So I set up fake Craiglist ads with his name and number selling weird things or asking for crazy stuff. Oh the good ol days! haha

eBay is a scammers paradise and there is really nothing that can be done.
I really liked some of the suggestions though. D*ck pics, CL, sign up on gay men for men sites are all great ideas. No real harm but at least the guy is harassed for a while.:)!

On the other side of the coin... I recently bought a 1984 Topps USFL set on eBay. When I got it the 4 big cards were missing. Seller claimed they were in the box. They weren't. I got my money back because of the eBay policy. So it does happen the other way too.
That being said, OP, this sucks hard.

I recently sold off my '55 Topps set and was contemplating ebay or an auction house. The story of what happened to the OP is exactly the type of reason why I went with the auction house. So many horror stories on ebay it's unbelievable what people get away with.

When I agreed to a refund on ebay, it wouldn't let me do anything other than offer him a full refund. You guys are amazing at tracking this dude down and I can't even imagine what kind of crap will come his way because of it. But it's nothing he doesn't deserve.

He lives in a Trailer Park! He won't care if law enforcement pays him a visit. It is a common occurrence in his neck of the woods. The hookers will warn him before they show up anyway, and he will hear all the crack heads and meth heads tweaking and freaking and running all over 'cause the cops are coming. Unless he is passed out hammered drunk?:D
