Important info for anyone using COMC Mailbox service
I've been using the COMC mailbox service for awhile, but unfortunately I just learned some tough info on it.
I purchased these three items... They sent me pictures and advised that it looks like it wasn't properly sealed. I opened an Ebay dispute and it was closed within a couple of hours and I was told that I won't be getting a refund. The reason? Using a third party consignment service VOIDS any buyer protection!! Wow was I shocked. I followed up with COMC and they told me they weren't responsible for this and to try to go through Ebay or Paypal. Ebay already shut me down, so I'm trying through Paypal, but I have a feeling it's going to be the same result. So for anyone using this service, beware!! A tough lesson for me to learn and I'm definitely only going to use the service for low value items from now on, and I'll be cutting back for sure. |
That's a real shame. Hope crook sellers on ebay don't get a handle on this or it'll happen all the time.

Quite frankly I wouldn't think its even pertinent info for eBay or Paypal to know whether or not it was sent to a consignment location. You didn't receive the items and thats all they need to know. Depending on how those items were shipped, the seller would be covered for items up to $50 each under the USPS policy.
Ultimately, the post office insurance policy should eat the cost. Both you and the seller would get your money back and he would get reimbursed for the cards that were missing. |

What ebay wants you to do is use there methods . Its just ebay being ebay pretty crappy on them. COMC has no say in this they use the mailboxes to help people out. |

This is nothing new, have told many that using the COMC mailbox could void your protection. There is a chance you will win, but I am aftraid given the seller in question he could have known this and made the right phone calls to get it voided.

Under ebay policy, there is a line that says the following when Buyer's protection is void.
"Items shipped to another address after original delivery." HOWEVER, I believe it was meant to use for mail forwarding. That is, if I change my address when I move out from previous apt, I can get USPS to forward all of my mail to my new address. The paypal can still have the old address, but USPS would do the work for the forwarding. That is not the case here. COMC is the intend receiver. Unless COMC lies or stole the card, COMC should file the complaint on behalf of yours since COMC provides the service as a BO box, and COMC should hold accountable for the customer service. |

I have dealt with one out of Florida, the item showed delivered to the Florida address but they claimed they did not get the right item and wanted a refund Ebay sided with me for the use of third party service. Also in what you describe the seller will lose if you state it was not delivered, the computer that check this for Ebay would see the delivery to the new zip code and say the item was not delivered to the correct address. Have lost a couple of cases where this happened. Got them reversed on appeal, but the intial resolution was a loss. |

COMC has no say on the purchase between you and the seller. Unless they paid for the item, like one of the third party shippers does, the buyer pays them then they pay and bid on the item for the buyer. Unless they are doing thet Ebay does not see them as part of the transaction. |
It is the seller's responsibility to get the card to the buyer. Let's see how the seller handles this.

Looks like a huge hole to play around the mail forwarding. And it looks like COMC does not tell you the full risk.

Why should they there are a lot of clear risks for using this service. Not saying it has happened, but what stops a dishonest COMC employee from deciding to pocket the card. Those photos are really not that great and do not show the envelope being opened. |

If the package was not insured the seller will probably be the one out the money. |

The cases were closed by Ebay in the sellers favor because of the third party delivery. So its on the seller to decide. I can almost guarantee the seller in question knew this loophole and made a phone call no other reason the cases were closed so quickly. |
There are two issues here relating to eBay protection.
First, the buyer is protected if item fails to deliver to third party. That is proveable (yes, exceptions exist) by delivery confirmation. The problem here is 'not as described.'. Ebay does not allow a non-enduser make this claim. An additional step has been added that the seller can't be held responsible for. I.E. theft or mishandling by third party |
Where those the only 3 things scheduled to arrive for you? I am not familiar with how this service works.

Could be just the angle, but to me that pic in no ways proves the package was received empty either. |
Had this happen once. File with paypal - goods not received. If that fails if you paid with your CC call them and reverse the payment.

And you will lose if DC shows it was delivered, learned the hard way on a 50.00 card that all I got was an empty envelope, I filed not as received and they said tracking shows delivered.. There is a selection in the Not as Described filing that says received empty envelope. The cases have already been closed in the sellers favor by Ebay, while its possible its unlikely Paypal will rule differently. If they do expect a 20 page thread from the seller. |

There is a law in place to put thief in jail. That is what stop people from stealing. If this is an isolated event, it is stupid to steal those 3 cards as there are more valuable cards in COMC. If this is a replied offense, I am sure COMC will get more than just OP's complaint and COMC would have called the police already. On the other hand, we need to find out if Imac did it many times for people who use COMC mailbox, or this is just a careless mistake. |

CC is different, likely Paypal ate it not the seller if the item showed delivered. The seller would be protected because they could prove it was shipped. However not all CC companies work the same, but nobody knows if a CC was even used. |

Or the other issues sellers have been having with submissions that they are not answering for. Damaged and missing cards are the biggest issue. Most crimes are crimes of opportunity, you are accusing Imac of sending it empty how do you know it was not opened in transit? This is why there is no protection too many hands get in the mix. |

I am writing you to inform you that you will be blocked from future purchases on my account. Your attempt to go around your lost case on eBay to reclaim money that is due to you from another company is highly frustrating and I do not wish to do business with someone who would resort to such tactics. I wish you luck in the future but your issues with COMC should not have been directed at me. |
I will address the many things not included in, and edited out from the OP.
1) The person received information from COMC that the package was destroyed (he did not upload the images provided by them that the package had tire tracks on it and appeared to be run over). Conveniently we seem to not be able to see that very black tire track looking damage on the package in the uploaded photos. That gives me even more questions about COMC. [B][I]EDIT** after further review in the second uploaded image you can partially see the track marks I am referring to. The buyer did not upload at least 2 other images that show this in much more detail. Again however.. should this damage occur in transit, USPS would not deliver it, rather put it into a "we care" apology envelope.[/I][/B] 2) If anyone on here has ever received a package destroyed in transit... they know they receive said package in a "we care" plastic envelope. The package received by COMC had no such envelope.. which means they were either lying, or something very very wrong happened here. 3) EBay has determined that yes, if you use a 3rd party for delivery you are voiding your buyer protection. I informed the customer of this before eBay had closed the case so they would not be blindsided by their decision. I also suggested they take that information to COMC and take further action with them. As the package was delivered to their company (confirmed by eBay and paypal).. the burden of delivery is now on them. 4) After losing the case the buyer decided not to accept this.. and filed with paypal for the exact same reason. After talking to paypal myself the case was escalated and will be found again in my favor. 5) Since yaga here decided to leave out major points of this issue I will upload some photos they did not. Afer this post I will upload the image they gave to ebay showing major damage to the package itself they seem to have edited out here and I will show you what the package SHOULD have arrived in if this damage factually did occur in transit. My theory of what happened here? Someone at COMC screwed up.. big time. Whether purposely or not (IE possibly stole the contents). When you see the actual damage to the package I am sure many will agree. |
It appears eBay has deleted the photos from the closed case found in my favor.. I ask the OP to upload those images them self rather than continue to try to smear my name. The package was not only sealed, but the label is also adhered over that seal to ensure safety. What you see in the buyers images are post opening of the package (IE contents most likely removed). Anyone that has purchased from me in the past is aware of how I package my items and can confirm this. Here is the image of what the package should have arrived in if it were indeed destroyed in transit...

I'm not trying to smear your name and I'm simply repeating what I was told by comc. I did not include the other images originally because comc suggested that the package wasn't sealed properly, and those two images show it best. I've had over 15K in sales (and I can't even guess how much in purchases) through comc and have been a loyal customer for years. They're not going to rip me off 80 bucks in cards to risk losing a good customer.
Sure I have no issues showing the other pics. Just remember... I'm the one who didn't get what I paid for, and I'm out the money here. |

You should NOT have posted these with exposed personal information as I requested you not.. but as everyone can now see.. this package was damaged to the extent of needing a "we care" apology. The fact that COMC says none was provided.. and the package has clearly been open leads to many many red flags.
I know many hate me on here, and trust COMC without question.. but please use logic here. EDIT: I did not reply to your message so I will here. COMC probably has no idea who handled this package originally or how they handled it. There are far too many questions about what happened here. They did not provide you with an image of the package before they opened it did they? |

I do not think you did wrong here (other than not providing all information).. I too would be upset if this happened. You just have to understand that the issue here is with COMC, not me. They are claiming a severely damaged package was not handled properly by USPS.. then only provided you images of an already opened package that they say had its contents removed. How on earth could I assume that one company did no wrong, while the other did? That's why buyer protection is voided for situations like this. For the record if a package has been damaged by USPS while in transit (which does happen frustratingly) I happily accept a return from any customer with a full refund of item cost plus shipping. |

According to the OP.. COMC is claiming a package severely damaged arrived without a "we care" apology letter... that is not possible. When you see the images we had to remove you will understand this better. The images currently seen on this thread are very misleading. |

Your cards were most likely lifted by a postal employee somewhere in shipment. Thanks for the additional picture. It does provide everyone a better view of what happened. Does anyone believe that COMC took advantage of this situation? Sure seems like a postal issue to me. |

Sure.. have private company's employees stolen items before? Sure... The fact that no "We care" envelope was provided on the package shown above is a giant red flag for me here.. that's the entire point of the issue at hand and why COMC should either provide indisputable information (IE the package pre opening)... or compensate yaga for their loss. |

Me too and I agree. Imac or COMC is not at fault. The blame belongs on the postal service whom have lost all pride in their work. Sorry to hear this happened. this kind of thing happens all to often. |

I have stated multiple times in this thread when a package is damaged to the point this one is claimed to be.. USPS puts the package in a "we care" plastic sleeve with an apology letter. That did not happen in this case. It would take a GIANT cluster F on the part of USPS for this to happen the way COMC claims. That being said.. I have had 5 packages "disappear" on me from USPS within the last 6 months.. I am highly frustrated with them lately myself. PS.. I have over 1000 items listed this week.. plenty of the kind of things you buy. Thanks for your continued business. |

it's just dirt outside and you can see the bubbles from the mailer. it looks like someone dropped it to a wet/dirty ground nothing else. try it by your self, take a bubble mailer and rub it to wett/dirt, the bubbles become visible. usps issue. but that bubble mailer looks like it was never sealed. |

It's either a stomped foot print or some sort of track.. that is very clear. If the item was wet at any point it would shrivel not tear... and again would come with the "we care" letter. |
