Default Won an interesting return case with ebay

I sold some non sport cards that were shipped to an odd address in Portland Oregon but the buyer was based in China... I strictly put in my listing only ship international using eBay global. Did not give much though thinking he did business in both cities. Over a month later, get a email from the buyer saying one of my cards was damaged in it way it way it was shipped.. he made a return label coming from China not from Portland Oregon . I called eBay, and was told this guy was on their radar and quickly closed the return in my favor with no further action on my part... guess the guy is some way going around their global shipping program as all his eBay sales are out of China. Returns must come come from where you shipped them, which is something new I learned.

Sounds like the guy's past went in your favor as well. That's why I think it's important to give eBay a call if you deal with somebody shady. Even if it may go against you on a technicality, you might end up helping the next person that has to deal with their crap.

Its in the policy that if the item is reshipped then the seller is not responsible for the damage. There are many shipping companies that offer a shipping service. You won due to the policy. I have won many cases like this over the years. Comc mailbox falls into the same category

I have dealt with at least 20 of these companies most with no issues and they are within ebay rules and not circumventing policy

What's his user ID? Just shipped a card in a similar situation...

Many collectors from China have a middle man/wharhouse (usually an industrial complex type address) based in the U.S. that does there shipping for them. It allows them to buy cards/items and pay shipping once a month or so instead of paying international shipping charges over and over.

I actually just sold a 2006 Topps Chrome basketball card to a Chinese seller, who also used an Oregon address. I did some quick research, and sure enough, it was a drop shipper. You are only liable for successful delivery to the drop shipper in Portland, what they do or what happens to it after is on the buyer or them.

I believe the logistics company is Luomaex and the address is:

7021 NE 79th Ct
Portland OR 97218-2814

And this is their website, translated:

There are 2 or 3 operating out of Doral, Florida. There are several large ones in California. All those Flyairways69 or similar ids that you may see pop up are all reshippers. There is one in Los Angeles that deals exclusively with Thailand.

I know this is an old thread... Care for anyone to share the ebay user id? I think I am on the same predicament here... The item is stuck with customs because they are asking for EIN number or Sales Tax ID from the receiver end. I am helping the receiver as much as I can. I hope my transaction goes through well. I guess I should contact ebay and tell them what's the hold up. The item is worth 2500 and it's a rule apparently that customs needs info such as sales tax id.

Can't help with the username but did you ship to a 3rd party shipper in the US or are you shipping international direct?

Shipping via UPS. All fully insured with adult signature requirement. So yeah. I think after this I'll never ship items to forwarding company if it's high value. Too much headaches

If you shipped it through UPS, you should ask them to advise you on what to do. Are you mailing something into the USA or sending it out? I can't think of a good reason Customs would need an EIN if you are sending out of the country.

shipping to forwarding companies is the easiest way to do it. once it is in their possession, you are off the hook in ebay terms.

if you shipped this (at least in ebay's eyes) to a third party shipper, and now that shipper is attempting to send the item overseas, you are no longer responsible for it. it is on the new shipper to get all that done.

you sent (again - according to ebay) the item to the buyer's verified PP address (hopefully you did this) and that address was in the US. you did not ship the item internationally, someone else did. they need to figure out the logistics, not you. that is their business., they should be able to do it.

If it was delivered to the us address and meets all the normal protocal then its not on the seller its between the reshipper and the buyer

So here's the situation in regards with the address. The buyer address matches in both PayPal and ebay which is the mail forwarding address. The issue is the package is coming from Canada and going to USA. Although I heard cards shouldn't get any or incure taxes since it was printed in the USA, it does require an EIN or sales tax ID/SSN if the value exceeds 2500. Some rules by customs. Item was shipped via UPS express service so no brokerage fees involved. I called ebay and notified them that the address is a forwarding address and the buyer needs to do his/her part to clear the package from customs. As long as he doesn't do it, I'm not at fault. Once he clears it, then all of the precautions I took should kick in, i.e. insurance, ID verification and adult signature requirement. I hope the carrier do their part because the insurance will bite them back. I was told by the rep because of the value they willl thoroughly investigate if lost package is filed. So I feel good about that.

In this scenario, it is entirely up to the buyer in regards to supplying the necessary information but you will most likely need to handle the customs issue through UPS if he's going to get his package.

If he doesn't have an EIN #, he can use this link to register:https://www.irs.gov/businesses/small...ber-ein-online

I forwarded him the form as well as what UPS said, if he could just get the EIN# of his forwarding company, then all will be a breeze. The silly part is he didn't seem to want to give the name of this company. If I could only find out which company in this address all will be easier. If he doesn't fix it, I will request UPS to return package and refund him.

Ebay will protect you in this case as long as you can prove delivery to the address provided in the payment. That is where your obligation ends.
From what I've gathered, He is shipping from Canada to a forwarding company in Oregon (who will then ship to the buyer). Because of the value of the package, Customs (between Canada/US) is holding the package and it hasn't been received by the forwarder yet.

Yes. I am browsing through forums here and it looks like a lot of people are having somewhat issues with forwarding address.
