Default Is buyer obligated to pay for item if it arrives after you've refunded?

Had a very patient buyer finally request a refund after three plus weeks with no update on tracking. Gave them a full refund and of course the package was delivered three days later.

Is the buyer obligated to pay for an item if it arrives after you have refunded their money?

If they have any integrity at all then yes. However most people in our hobby have no integrity and are always looking to take advantage of someone if allowed to.

This happened to me, as the buyer...I waited 87 days before requesting the refund, which the seller promptly gave me (was about $25)...wouldn't you know the card shows up the very next day....with grease/track marks all over it....clearly the PO's fault.

I immediately contacted the seller and gave him the $25 back.

I don't know if it's "most" people....but definitely enough to cause headaches.

It's possible eBay customer service may contact them and remind them of their obligation. It's also possible eBay may compensate you directly. I would call them.

No I have not contacted them. Curious to see if they contact me. If they don't I'll probably just move on, its not about the money. I really just want to see what this buyer will do.

Plus I want to know if per ebay rules once I refund the buyer is the transaction considered closed and the buyer is not required to pay. Might be good to know for the future.

Reach out to ebay. You have a 30 day window to file an appeal on the transaction. Before refunding I would message the buyer asking if they will pay for the item or return it to you if it shows up. If you have them agreening to something in messaging that will help your case. Better results with ebay if you talk to someone directly then their automated system but it is not often when you can actually get a live person.

Thanks great advice.

I just did an online chat with ebay, they will contact the buyer.

If anyone else needs to do the same its helps if you have the item number, buyers ebay name and the tracking number.

With all the delays in USPS shipping requests for refunds are going to go up. I have had several packages take close to 4 weeks to get there. One of the buyers left me my 1st negative because there was no movement. Still arguing with ebay to get it removed.

You are correct, the requests will be increasing. Just had a second buyer file a did not receive claim because its been a week and his package has not arrived. I sent him an email asking him to be more patient, have not heard back.

If that guy keeps the merchandise after your refund, that would constitute unjust enrichment. Depending on the details of the original purchase contract, the delay in delivery could be deemed to be a breach, but that seems to have been cured within a very reasonable time. So I think you are in the right. If that buyer elects to keep the item, he or she needs to pay.

This issue happen to me recently and the seller decided to ship another box.Then fast forward 2 weeks later the first one arrived.I Repeatedly ask the seller before and after and he refused payment and wished me a Merry Christmas.I end up finding out the reason was first class and it was lost for 10 days in some warehouse.

I have paid them back friends and family in the past. I figure they did me the kindness of going through the process and not running me over coals for requesting. Plus I know how ebay can be toward small scale sellers. I've only faced it twice and they were small purchases, but yeah, I feel it is a solid thing to do and put those good vibes into the card community.

Also request a package intercept wherever possible so if it turns up the package gets rerouted back to the sender.

Just went through this twice. The first time I contacted the buyer saying I saw that the card was finally shipped. I would appreciate it very much if they could send it back. If they write “refused- return to sender” on the envelope they won’t have to pay for any shipping. The buyer responded back if they could just pay me again and keep the item. They paid, situation was resolved. They were pretty patient while waiting for the item to show up too, great buyer.

The second time it happened was with a nightmare of a buyer. She opened an INR case two days after ebays delivery estimate and started sending me messages about how I was tying up her money and didn’t care about her. Real weirdo stuff. Ebay gives the item 10 days to show up and of course it doesn’t. A month later I get an email that the card started moving again. I file a package intercept with USPS. I get an email that the package intercept was successful. The next day I get an email that the package was delivered to the buyer. I immediately contact eBay to open an appeal. They deny the appeal stating that I voluntarily gave the buyer a refund. I sent the buyer a message, she never responded of course. She ends up giving the package back to the post office to send back to me. I just got it and noticed she opened it before returning it and swapped my card out for one she had in her possession.
