Default eBay preseller trying to cancel one of my TC case orders...any recourse?

So I preordered two cases of 2013 TC hobby, have been excited about it for over a month. Both auctions ended on 8/29 and I paid the next day. Today I get this message from the seller:

Chrome came in today, for some reason the shorted me one case. I'm sending the one to this information. (xxxxxx). I will refund you for the greater of the two cases, $679.14. I will send you a cancelation of auction, please accept the cancelation so I can refund you. I called topps and they said my rep should of told me I had a 5 case limit. I ordered 6 cases, and your action for the buy it now was the last auction sold. I'm sorry once again! I have doubled boxed your order, and It will have signature confirmation on it. Thank you and have a blessed day!!

First of all, anybody buying this? Second of all, since I was pretty pissed off as soon as I read the message, I checked out the guy's completed listings, and sure enough, he sold one more case on 9/2, after I bought and paid for both of mine, so his message was an outright lie ("I ordered 6 cases, and your action for the buy it now was the last auction sold"). He tried to cancel the transaction, which I declined

So I've got two questions: first, what happens when a seller tries to cancel a transaction and the buyer declines? I've never had to go through that process before. Second, do I have any recourse other than to make a stink and leave negative feedback?

tell him to send a refund PLUS the difference it'll take to get another on your own. and you agree to cancel AFTER not before...

who is the seller? does the feedback show a history of this? there is not much you can do, you are not getting your case no matter what. might as well get your money before the paypal claim time ends and he/she can keep that too.

I would get your refund the way he said. Accept the cancellation from him.

Strangely enough, you may also get a refund under the buyer protection plan. I did a few years ago when I ordered a couple cases of Ginter and the seller ran into problems and refunded several people. Got my refund and money from Ebay. Maybe it was a glitch on their part..but who knows??

He already tried to cancel and you declined? I don't think he can cancel again.

There is no recourse for a buyer, you can get your money back and leave a negative. That's all you can do.

You did right by declining it, he should have refunded first then ASKED you to cancel the transaction. If he does not refund or he tries to make you pay the fees out of the refund you have a legitimate claim.

Most likely it will have to be SNAD because I am sure he will send the other using the same DC so if that shows delivered you will lose a INR, but then again Ebay has that new rule that it has to be shipped within stated handling so you may win an INR.

When you do get your money back make sure you leave appropriate feedback

Thanks for the replies everyone. I just got in after being out for a few hours. I replied earlier and called out the seller for his blatant lie that he was refunding one case because it was the last purchase, and got this response:

I was mistaken, I ordered 7 cases. I'm refunding that case also. My hands are tied. I've never had a problem getting my cases in the past. I'm being honest and up forward with you, send the one case and refund the second.

So it seems like the consensus is I have to just accept the refund and forget about getting my second case, and then bury the guy on feedback?

Also if anyone is interested the ebay name is riverdawgs2013 and before this transaction he had 99.4% feedback, but with under 200 transactions and only 40 as a seller.

I know they're not the cheapest, but after a few problems buying cases on Ebay I now buy only from Blowout

Put yourself in the sellers shoes, what would you do in his situation? I think you have to assume he's telling the truth and does not have your case.

If I were the seller, I would email the buyer telling him that because of distribution problems I was shorted a few cases and cannot fulfill my final orders. I would ask them to cancel the transaction through ebay and let them know I would be refunding them.\

...isn't that what the seller did? What else could he do?

It wasn't a distributor, he claims it was Topps that "shorted" him cases. Which is the worst freaking excuse ever given that Topps would do whatever it could to keep his preorder money.

I'd take the refund and run. Just be glad Topps didn't push release back a month and end up with your product releasing 60 days after your pre-order was paid for. I think at that point the seller can take your money and run from what I've read on here in the past. That 60 days was the limit on opening case for not receiving item after it was paid for. Could be wrong...but main point is open the one case and take the refund. After opening the one, you may be happy you have the money instead of another poorly collated case full of Kyle Gibson redemptions.

I think some of these guys presell 2x as much product then they plan to receive just to create more cash flow to pre-order other products themselves. Thus what in turn they have done is pre-order as much product as they like without having to tie up any of their own cash!

u cost that dude around 70 bucks in ebay fees by declining the cancel cuz now ebay wont refund his final value fees

either way your not getting that 2nd case and if i were the seller i would refund you minus the ebay fees and make you have to file a case with ebay to recover those fees and drag it out as long as possible

Wow. You're a dick. The buyer did nothing wrong. He was protecting himself. It was the sellers mistake for over selling.

The seller now made no money off the first case he sold to the buyer. Sounds fair to me.

Thanks for all the replies, guys. The seller issued a refund and I guess I will just agree to cancel the transaction. I'm going to wait until my second case gets in though.
