Default rules on a "sealed case"

not my auction .

but am I right when I say he incorrectly listed the item ? it is listed as brand new but the case is clearly opened .

yet , years ago I had to refund someone . because the "product" was not brand new . the seal was opened up. but every box belonged to the case . the buyer won. I guess things have changed.

The worst part about it.........it dont matter.

You could buy that, open all the packs, pull a brady, keep the brady and send the rest of the cards back and just say it arrived that way and you would get a full refund

Or you could buy it, not pull a brady and then just send it all back and say it arrived that way and you would get a full refund.

It dont make a diffrence how it is listed. Thats what Ebay has become.

That is an auction for 6 boxes. 6 boxes shipped inside a cardboard box. The fact that the cardboard was from the same product is irrelevant. The boxes could be from another case(s). A "case" that is opened is not a "case", it is an "opened case". Just like a "box" is not a "box" if it is opened. It is then an "opened box".

A case is a case no matter what. A sealed case is just that. An open case is just that.

Adding an adjective changes things, but that is what they are there for!

This seller listed a "Full Case". This case is 100% full. No where do they claim the case itself is sealed, only the boxes within are. But it is still a case full of boxes.

In fact, the seller goes as far as to say the case itself is open, and includes pictures of, wait for it, an open case!

There is never an instance where an open case suddenly fails to still be a case. Same with your box example. Hell, even an empty box/case is still a box/case. Just empty, opened, sealed or any other adjectives tossed it to further describe it.

Experience or just conjecture?

I’ve seen posts from some sellers claiming they won cases vs buyers trying to return opened boxes/packs.

Things may be changing shortly, though I don't know how eBay will handle disputes. Apparently if a buyer sends an item back damaged or with missing parts/pieces, the seller now has the option to send a partial refund through the automated returns system. What I don't know is how eBay will respond if a buyer alleges that they did not send the item back damaged. On the surface, it looks like eBay is finally giving the sellers some power. I just don't know how it will be enforced.

Once ebay have that change up and running we should test it out.
I'll pretend you sent me an action figure with a missing head and we do the return process and see how it goes.

There was a thread on here awhile back that someone did this to someone with I believe some National Treasures stuff.

I will search when I get home from work tonight to see if I can find it.

I know the seller lost the case, but dont remember the exact circumstances. It was a good and interesting read. It was not to long ago.
