Default Need help with Panini Customer Support

I sent in a 2019-20 Ja Morant RPA which was damaged in the encased holder for replacement. Panini sent me a 2018-19 Ben Simmons Revolution Galactic in return. There is about ab$1,100 difference in market value. I emailed them and Twitter them with no response yet. No one answers their phone number. What can I do? This is really not a fair exchange. Not a rookie, autographed, relic, numbered and low value set. This is crazy!! Any advice would be much appreciated.

Good lord. I hope this gets corrected. Sorry that I don't have any suggestions on how to get a hold of them faster. Hopefully others do.

Have you actually gotten the card(s) yet, or are you just going by what is posted online? I think there is a good chance Panini is sending the damaged Morant back to you, and also sending you the Simmons Galactic to make up for the damage. I wouldn't think this was a straight replacement.

None of this is going to end until we all take Panini to our local small claims courts across the country. I guarantee you if they have to send an attorney out to a hearing, they're going to start thinking twice about whether they continue to ignore you.

It does say compensation card, not replacement. So I hope they return the Morant as well.

Sorry, not going to work. They wouldn't bother sending anyone and plaintiff gets a minuscule judgment that needs to be enforced to see a dime.

It's either superior court for the big bucks and/or class action suit.

The point of small claims court is no attorney required... they wouldn't send one. In fact in most states attorneys are not allowed in small claims court. That's why you use it.

I appreciate your pessimism, but I disagree. I think small claims is precisely the place that a dispute like this belongs, if we're talking about damages of a thousand or so bucks.

It's a large enough award that you don't need to form a class to make it worthwhile, but it's too small an award to warrant full-on litigation you'd need to persevere in superior/district court. Small claims is the only fit.

As for Panini ignoring a judgement, I had to chuckle a bit. If you think large mega-corporations are in the business of simply evading valid legal process, I don't know what to tell you. There's a ton of risk in doing so, not the least of which is losing even more in the attorneys fees from recovery. So, it would be easy enough to find a lawyer to do so.

Not to say there isn't some risk/challenge here. The biggest issue is that there may be some terms somewhere (perhaps when submitting the redemption request) that handcuff your rights to litigate where or how you want. Also, most small claims courts allow removal to superior/district court on motion, so if you got stuck with that, you'd quickly be in over your head as a pro se litigation.

However, I really think the most likely outcome if you made a filing and served the defendant would be that the legal team at Panini would take about five seconds to realize that contesting jurisdiction, venue, or whatever else, or fighting on the merits, is going to cost them a helluva lot more than the settlement cost, so there's your win.

I've heard of companies sending very clueless non-attorneys to represent them in small claims, and it usually works out well for the plaintiff.

I think it's likely they would send someone, whether an attorney or not. Even the travel and per diems would quickly make settlement a better option for them.

I see that I'm attracting some of the other legal minds on this forum. We should form a network to bring cases like this in our home jurisdictions, and to go after rip-off artists online that live in our jurisdictions. I see people have bad things happen to them and they just resign themselves to losing pretty huge amounts of money in some cases and it breaks my heart.

Lol depends on what you mean by mega-corporation. Unfortunately, I'm speaking from hard-won experience when I say you'd be surprised at the size of businesses that try to ignore judgements and need to be dragged back to court.

I got a response from him just 2 weeks ago, so I think he's the guy to approach. Only problem is, a lot of the incoming emails are supposedly getting filtered into his spam folder...

Add the person as a contact (last name and at least first initial) then write the email. Without recipient's name in the email address, and also included in body of email, bigger chance your message gets the spam treatment.

Just want to follow up, it was a compensation card. My original Morant was included. Thanks for all the comment and thanks panini for at least trying to fix and issue where they couldn't find a replacement.

glad to hear that got resolved, and they let you keep the card! when I tried to have a 1/1 Dominique Wilkins replaced before, they sent me a Giannis auto /49 which is cool, but not a 1/1, I wanted to just keep the damaged card but when I called they said they shredded the original. maybe one day I'll see it on ebay from an employee's account...
